Why case is delayed

Common Reasons for the delays are :-
1. The applicant or defendant who knows that his case is week, keep taking dated through advocate.
2. The Public Persecutor who should fight for case registered after FIR, do not take any interest to fight thus making case delayed & week.
3. Advocate keeps taking dates on excuse that his "senior" is busy in other court.
4. Advocates are the officers of the court but on many occasion misguides the court resulting in the wrong award. more

Why should we the consumers group hire HONEST and the BEST lawyers to fight our cases and for this everybody has to contribute money depositing in the bank. Just think how can it be done and let us try. more
Like specialist doctors in the field of ENT, Ortho, Gyne etc., same specialisation should be done in post graduation courses in Study of Law. We want specialists in various fields same true for judges. This drastic change should be implemented to see the visible speed in delivery of justice in years to come. more
Mr.Prasad I agree with your explanations and I find pity on our judges. more
So many reasons will be obvious like envisaged in the initiation of this topic viz., dragging on by parties losing the case or advocates. These all can be checked by court of laws if they want. Why they don't do is they don't find time. Yes, I am right. The courts in India have no time. They are burdened heavily with work loads. In each and every case courts can not say only defendant is wrong or plaintiff (complainant) is wrong. So Courts are bound to give equal chance of being heard to both the parties on either side. Then the capacity of the courts to dispose the cases lawfully and justified will be lessened. The cases initiation in courts are much more than the capacity to dispose off them. Suppose if a court can dispose of 50 cases a year the initiation is about 100. The world average of number courts for a million of population is 45. In USA it is 55. Whereas in India it is only a 11. We are poor country and we need more money to establish more courts. This is the main reason courts give adjournment to another day of cases as prayed by parties or lawyers until the serial of the case come for. Courts check these tactics of lawyers or parties when the case gets its turn. Only 2 or 3 times the advocates can play these tactics. The main result obviously of this is delay of justice. The unseed danger of this position is the mafiatic activities like settlements by political mafia, police mafia, Gundas etc. Indian Citizens beware of this!! more
