Can a Co-owner as wife make a Trust deed ?
Sale deed has 2 names-Husband & Wife.
Husband is living separately in another home and wife was earning to buy flat,( Husband had No source of income)
Wife is paying for maintainance of flat,including house tax for past many years and she is also paying for education/wellbeing of her daughters and their marriage after education from best private schools and universities.
Builders Do Not Like It because husband as inheritor wants to get rich quick.
A good lawyer suggests wife to make a Trust deed after 20 years.
Wife does not ask for money from Govt/Private individuals.
It is Self Sustainable Trust and has a bank account to pay for basic maintainance of place.
Husband died instate.
Mutation was done using the rule of 2 out of 3 because one of the married daughters did Not Relinquish,despite getting her own flat,helped by her mother.
MCD has issued a token of ownership to wife.
Records of MCD will be online soon.
What is more important?

I am sure that you are aware of 'Damaad' syndrome in India. Unemployed Son-inlaw got angry when his name was Not on Sale Deed.
Father in law had no choice.
On sale deed,there is no option to mention 'Courtesy' but learned people are aware about it that husband contributed nothing to buy flat or to maintain it or to bring in dignity within the home. more

Since it is a self acquired property both owners have equal rights. As husband has died without making a will his share in flat will be divided equally to wife, sons and daughters. You are free to create a Trust for your portion in the flat. more

I am not a Lawyer. But as for as my knowledge goes since it is your self earned property ( you have to prove and in the Trust Deed you have bring this first ) you can make Trust. But then the flat is in your name and in your husband's name,. After his death as per the Legalhair Certificate you three(yourself and 2 daughters) are to inherit your husband's share in the property. Since one of your daughter released her rights in the said property you two have equal share. There are two options for you. one you could pay share of ( for your husband's half share divided by two) your daughter by cash or in any other form and get release from her. But certainly you have consult best lawyers in Trust deed experts.
