VERDICT IN SC AGAINST TN GOVERNOR
- First of all it is not clear if the bills passed by the TN assembly is the voice of the people of the State. In this case, it is very clear that the majority party in the assembly has voiced its assent to the bills that may not necessarily reflect the voice of the people.
- what about the repugnancy?. It is very clear from the day bill came to Governor's assent that it is against the laid out norms that does not necessitate a change. The Court has not considered this issue at all.
- Governor post is a non-political arm of the Governance and he is appointed to guide that State in matters relating to its welfare. Agreed that there is a conflicting interest in the relation between the Centre and the State, but what about the merit of the case? Bills are being used as a tool to antagonize the Centre. How can one take it as a will of the people of the State. It is obvious that the State Government has not lost an opportunity to irritate the Centre on multiple issues. Does the Court not know this?.
There must be a appeal against this verdict and SC must decide the case purely on its merit without any bias. more
