Tenant causing lot of trouble

Hello everyone,

My tenant is causing lot of trouble. He is not vacating from past one year and
now is not paying the rent from past 4 months. Electricity bill and water bill also pending. Whenever we ask him to vacate he is saying that he is not finding another place and he does not have money.

The only reason he is troubling us is because we are not the guys who get into fightings etc. Now from past 4 days he is not to be seen and the house is
stinking of garbage.

Please let me know what to do in this situation. I called a laywer and he says it will take about 3-4 years to resolve if I start a court case. Why is our system so bad for good people and so advantageous for bad people.

Dear friend, if you are the legal owner of the building you can definitely contact a trusted lawyer to file a case for Eviction notice and there is a Supreme Court order saying that legal owner has every right to get the tenant vacated if you are planning to occupy the house. Even otherwise through court you can ask for rent based on the value determined in that area under the Rent control Act. Not paying the rent is a valid reason for evicting the tenant more

Beg to differ Amit on the situation of the system - from a citizen point the legal system is below average. I am not a legal person hence I cannot comment on the eviction of the person - but in most of the cases in south delhi eviction has taken place even before the cases are filed by using the legal letter or what is termed by my lawyer as legal notice
an analogy - when I wanted a bike my father refused - I told him I could drive and I was a good driver - he told me one thing - you may be very good - but it is the other drivers and the circumstances which matter .... more  
You should not take Law in your hands. Only course open is to file an eviction suit in court though it takes very long time to decide.But we are helpless unless the entire Legal System is improved. more

please Sandeep lets instead of using 'hope' word start using expect and demand ...is it not a high time that we as citizens also help government by telling them we are not happy with certain issues - one of them being this ...don't know if you are aware of the serious situation of shortage of lawyers and pending cases increasing more  
Rasik sir I agree with you 100%. Almost 95% of all our laws have been made by the Britisher during their regime only with the intention to keep us the Indians as their slaves under their command. Unfortunately all those laws that Britishers made and used against the common man is still being used by our successive governments till date. We can only hope for the best that things will improve over a period of time more  
lawyer can handle the issue without taking it to the court provided you hire the right lawyer - case can be filed against the person ....engage a lawyer ...force open the door and take possession of the house ...very less chance the person would file a case against you in court taking into consideration the facts are not in favor of him - besides that filing a case would take both time and money and efforts - he would probably move one. Besides that it is very important you raise an "alarm" in reference to the smell ... more  
The First and foremost, is here any agreement / Document to the effect to prove that there is tenancy. If yes, you are abided by the relevant law. If NO, you are abided by general law, wherein you can take the possession even by police help. more
