Now there was no communication at the entry point about the jam. It was when one traveled a distance of about 200-300 mtrs, he faced such a scenario.
Now when it was a total jam, the toll booth operator were still charging the toll fee and causing further slow down and jam. Now the question is whether any case can be build against toll operator as it failed to 1) to provide smooth driving which is expected from any toll road, 2) failing in warning to the motorists about traffic jam ahead thus preventing road users to look for an alternative route which was without any toll fee. 3) causing further jam and still charging toll fee. Could it be brought as deficiency in service and can a case preferably be class action suit be taken up with the consumer foras. The company has not even expressed apology to a message sent to them on whattsapp. more
2. The toll fee is charged for providing a smooth journey to the motorists which the authorities failed to provide. The traffic after crossing the toll gate was not too congested that means the traffic problem was exaggerated by the toll gate as one has to pay fee, then gate gets opened and then the next vehicle approaches.
3. I recall SC judgment (I am yet to retrieve) where it was stated that if the waiting vehicles at toll gates cross particular line, the authorities have to open the gate to allow free passage. This was in relation to Express way on Delhi Jaipur road and finally the toll gates have now been removed.
I am seeking the help of an advocate if someone voluntarily take up the issue as a public cause. Let the issue get sensitize. more
