Seeking your opinion

On 19th March 2015, there was a total jam on DF Skyway (is a toll road) at Badarpur, Delhi. The jam was so dense that the road was virtually blocked and it took almost 1 hr. 45 minutes to cover a distance of around 2 Kms. There are two exits, one at Badarpur Border and the 2nd one at Sarai Khawaja a 2kms further away from exit at pt. No.1. The 2nd exit point was closed due to dharna and hence all vehicles were being diverted to exit from first exit i.e at Badarpur Border. As far as toll rates are concerned it is equal at both exit.

Now there was no communication at the entry point about the jam. It was when one traveled a distance of about 200-300 mtrs, he faced such a scenario.

Now when it was a total jam, the toll booth operator were still charging the toll fee and causing further slow down and jam. Now the question is whether any case can be build against toll operator as it failed to 1) to provide smooth driving which is expected from any toll road, 2) failing in warning to the motorists about traffic jam ahead thus preventing road users to look for an alternative route which was without any toll fee. 3) causing further jam and still charging toll fee. Could it be brought as deficiency in service and can a case preferably be class action suit be taken up with the consumer foras. The company has not even expressed apology to a message sent to them on whattsapp. more

Even delhi metro has the same problem last sunday there is some problem from sultanur they were not announcing in the station but in train after entering they announce the train terminates at sultanpur. almost 3 to 4 trains were terminated at sultanpur. there was heavy rush in all stations after mg road.but when the problem solved instead of running those terminated trains at sultanpur first they allowed train from gurgaon to move which resulted in suffocating in the train. when there is problem why they have to run train from gurgaon till sultanur. more  
yes, I read it in today's HT, a full fledged report on page3, where reasons and explanation is given.must read. imagine if an ambulance gets stuck in this? I am sure our next generation would have made it mandatory for ambulances to have aerial pickup arrangements ( hooks etc ) in their design to air lift them as under carriage in emergencies. more  
The principal reason for almost all of out traffic woes is one, we do not follow traffic rules and drive whichever way. There is little point in blaming authorities for this and that, if we, the citizens, are not going to play by the rules. Until we assume responsibility, nothing but nothing is going to save us. more  
Dear Mr. Dalel, It is very nice to have your comments on the issue. I respond to: 1. The traffic was jammed due to a fact that there was a protest (by clean yamuna protesters) at exit No.2 and most of the traffic cross the toll road at exit No.2. Now if the exit at point No2 was blocked was it not the duty of the authorities to inform to the users at entry point so that the motorist should have taken a informed decision as to whether use to road or take alternative. Could we not consider this as a deficiency in service?
2. The toll fee is charged for providing a smooth journey to the motorists which the authorities failed to provide. The traffic after crossing the toll gate was not too congested that means the traffic problem was exaggerated by the toll gate as one has to pay fee, then gate gets opened and then the next vehicle approaches.
3. I recall SC judgment (I am yet to retrieve) where it was stated that if the waiting vehicles at toll gates cross particular line, the authorities have to open the gate to allow free passage. This was in relation to Express way on Delhi Jaipur road and finally the toll gates have now been removed.

I am seeking the help of an advocate if someone voluntarily take up the issue as a public cause. Let the issue get sensitize. more  
It is definitely a deficiency in service but recourse to court is not likely to yield anything. more
