Seek legal advice

Mr A is a doctor and his wife is also a doctor. Mr A's father was doctor who died in a car accident. Mr A's mother is employed in a Central Government and withdrawing a salary of Rs 90,000 per month. She is also getting a pension of Rs 55,000 per month (her deceased husband's). Mr A is living with his mother in the house built by his father but registered on his mother's name. There is a 3 bed room flat which is registered on Mr A's sister's name.

Mr A's and his wife were working in a private hospital when his father asked them to resign and start their own clinic. But ill luck would done it, father died before opening the clinic. Somehow Mr A has started the clinic in a rental accommodation with the monetary help from his mother.

Now the problem is:
1. Mother doesn't want them to stay in the house which is on her name. No provocation, may be her friend fill her ears.
2. Mother wants the money she has spent on Mr A's education and marriage.
3. All arrears, money from his father's job is received by the mother and deposited on her name.
4. All fixed deposits are transferred to mother's name and Mr A's sister's name (who is working with her husband in USA).
5. Mother is 55 years of age and threatens to remarry.
6. Starts nagging her son in the morning till they sleep in the evening.
7. Behaving like a mad person when they are alone but changes to opposite in front of relations and friends. Even says all this belongs to my only son. What will we do with this money etc etc.

I would like to seek advice from the forum as to what are the rights of Mr A and whether he should leave the house. Mr A is childless as yet. more

Dear Members, Is there any Sansatha or Social Group nearby Ahmedabad, Gandhinagar or Vad Nagar where the son could request assistance in motivating his mother to see the sense for greater benefit of the home? Thanks in advance. more

Thanks Mr Rajkumar Jain ji. Father met with an accident and has not registered any 'Will'. It is good news that his son can have 1/3rd share. But Mr Jain under which section of the law? Does this apply to all the States of India? The son along with his wife is forced to leave the house. They are doing so on 6th July. They are told not to come back as nothing belongs to them. The son is not bothered about the money or property but worried about his mother. He has asked her to let them stay with her without any claim on the money or property. Being a good son, he is ready to give this in writing in the court. (his father asked him to take care of his mother). But the mother is very adamant to send her son & DIL away. (Mother is LLB and understands the law fully). more  
When did ur father expire.pls advise,As per Hindu law a lady co-parsner is absolute owner.Has ur father left a will.pls advise.she cannot demand money spent on education and marriage or any other expense,untill she proves that it was a loan to u. In the absense of will u have 1/3rd share in ur father movable & immovable assets. more  
Thanks Mr. Sharma. Mr.Thirumalai Rengarajan, please note that no REGISTRATION OFFICE will ever accept a will to keep it in their custody. There are so many other ways to keep it, including your own locker. Please dont misguide. more
