Power of Attorney
We have a house in Rajasthan in my Mother's name. Since she is staying with me in NOIDA and confined to bed, we have decided to sell off this house.
Can the transfer registry be done through Power of Attorney?
If yes, should it be in my Father's name or my name?
Can this Power of Attorney be executed in NOIDA (Uttar Pradesh) for transfer registry in Rajasthan?
Further, I have one Sister. Any formality required from her side?
Advice is solicited please.

Some legal experts are participation. I would like to take advantage of their opinion which may be of help in this case also We have a residential property in India Haryana. Registered in the name of SM nd his wife NB. THEY WOULD like to gift same to their son SK and his wife SV. MY QUERRIES:- 1. Can SM & NB jointly execute a gift deed on favour of SK & SV TOGETHER (to become joint owners) 2. Where should the GD be expecuted at a local NOTARY or it has to be at Embassy/ Councillate 3. After above execution does this GD need to be registered in India 4. Can SK & SV thereafter sell this property in case the SD is not registered in India 5. In case we don’t or can not go ahead by GD process, whether SPA jointly by SM & NB to SV ‘Authorizing the GD execution in India in favor of SV herself and SKB’ is feasible 6. Can such a SPA be executed at a local Notary in USA AND WILL THIS NEED REGISTRATION IN INDIA Thanks for an expert advice. more

1. Yes, Sir. 2.Both are accepted. But, it is better to get it done from Embassy by their Authorised Signatory, 3. As per rules, it does not require further registration in India. However, sometimes, some offices are asking further registration in India 4. Yes sir. 5. Yes, Sir. Rules for registration of GD and SPA are same. Regards. more
