non payment of maintenance dues by members

sir your query on non payment of Maintenance. The first thing is to send a Legal notice either through an advocate representing your apt association or by the secretary of your association. give the person atleast 10 days times from the date of receipt of your notice, failing which you could mention are to why action should not be taken against him.
Actually essential indemnities like water and electricity cannot be cut off, but you could threaten to do do nevertheless don't allow this person to use the other facilities , if any, of your apt like, parking his vehicle, disposal of garbage etc. also post a notice of the defaulter in your bulletin board/Notice board at the entrance to the apartments for all to see.

Could you please point me to reference to any act or law or court order of not cutting water and electricity of maintenance defaulter? more  
This is the valid advice I feel. I am fighting similar case in Maharashtra for 11 years. Maharashtra Co_Op act has section 101 to obtain a recovery certificate from Deputy Registrar of Co-Operative Societies. However one (defaulter) can ask for revisions to Assistant Registrar of Region or Co-Operative Minister of state. However the defaulter has to deposit 50% of dues if application is accepted for Revision. But not any circumstances 2nd revision is allowed. I would request members who advised to cut water supply not through such advises unless they have proper knowledge of law. Implication of such advises will put the advise seekers in to trouble. more
