Dear Sir, YOu can ask for a detailed report from the admission to discharge hospital will prepare and submit on your request. You may not be able to findout in that, with that you can consult another physician and enquire on your doubts along with your legal advisor and file a case with Director Medical Sciences copy to Ministry of Health through my gov you have an option of loading your complaints. Complaints redressal mechanism is available, raise your complaint through that channel along with reports and legal notice served to that hospital. Automatically detailed enquiry will be placed and justice is expected. more
There is Civil, Criminal and Consumer Remedies available. It is up to the claimant to decide which and to What extend he suffered and desire to go for. In Civil remedies - which is time and efforts consuming will give the returns as compensation. Criminal Remedies can Punish the intentional/deliberate negligences. Whereas the Consumer Forum can give less time consuming, speedy remedies in comparison with remaining two. more
Dear Friends and members of this group. today there another post from our friend Mr. Ravindra Singh giving the fact for what he was hospitalised. The reply to that post appended below.. In this post even I gave the opinion suit against the hospital. That is purely of the negligence of the hospital will be proved. One of my friend in this group told me not to invoke any one emotion.. I sincerely apologize my reply have invoked the emotion of any of the friend or the member of this group. Intention is not that to invoke any emotion at the same time negligence and carelessness must be punished. Now the reply for the new post has been appended for your reference.. Dear Mr. Ravindra Singh There is a post of your earlier not giving the fact of what for your son hospitalised. There are so many comments advising to go to court proceed with legal on consumer forum etc. In this post you are mentioned the age and the nature of disease for which he is admitted and treated. The causes for the disease is as follows Hepatitis Types and Liver Risks Hepatitis means inflammation of the liver. It can be caused by several viruses. The main types in the United States are A, B, and C. Type A symptoms are often similar to a stomach virus. But most cases resolve within a month. Hepatitis B and C can cause sudden illness. However, they can lead to liver cancer or a chronic infection that can lead to serious liver damage called cirrhosis. Hepatitis A is spread by eating food or drinking beverages that have been contaminated with the feces of an infected person. You can also get infected through close contact with a person who has hepatitis -- for example, by changing a diaper or through sexual contact. Poor sanitation and poor hygiene increase the risk. Hepatitis B and C are spread mainly through infected blood, semen, or other body fluids. Hepatitis A outbreaks have been traced to eating contaminated fresh fruits, vegetables, and salads. Wash produce well before eating, even if you plan to peel it. You can also get hepatitis A by drinking contaminated water. Because shellfish is sometimes harvested from polluted waters, uncooked oysters, clams, and mussels can transmit hepatitis A. In this situation without knowing the clear reason for the death of your son it is difficult to give any clear direction. The basic reason is the stage of the disease is most important. This disease has the three stage of "A" "B" and "C" all the stage the danger of death is increasing step by step. For this the treatment will be more fluid items than solid one. Fluids in the form of not boiled also included like buttermilk, tender coconut and other items like will be given to the patent for control along with the medicine. As mentioned in the above the possibilities is also lying with the take carer of the patent. So it is very difficult to jump into conclusion to direct any legal opinion. If you opted any legal action you need to prove so many details. Do you think it is possible for you to produce... Now you put a new question seeking help how to prove the negligence of the hospital? I don't think no one in any profession can give you the clear idea or direction for this question.. " THE SIMPLE REASON ALL THE PROFESSIONALS ARE NOT HAVING ANY INTENTION TO MISCARRY THE PROCESS OF THEIR PROFESSION.. THAT IS THEIR BREAD AND BUTTER" It is simply in my opinion. you have no other choice blame on your misfortune than anything else. more
Dear Mr Ravindra, my comments were incomplete. It is necessary that medical negligence has to be proved. First reserve the medical records. Second consult a doctor who can help you and find out that Pneumonia was a result of lack of adequate sterilization and disinfection or hospital rooms or ICU.Find out whether there were any other cases of such nature. Get the opinion of the doctor. Then consult an advocate.Let the advocate be a sincere person who has come interest in the welfare of the society. You can claim compensation if your case can be proved. Wish you all the best more
Dear Mr. Mittal: Thanks for keeping the topic alive. You were so severly offended by my observation. Now please look at the comments by technically qualified and educated persons. I am certainly a generalist!!!! more
