Free legal Aid for women in Noida

Would be grateful, if some one advise where the free aid legal cell is. A girl aged 59 years, not employed, lost both her parents . The house is in her mothers name who died interstate. The brothers are businessmen. For 9 years she took care of her bedridden father singlehanded. She has been living in this house GF since 1991. Some portion on 2 upper floors is rented. Can she be evicted ? What are her rights ?

1. Every High Court is having Free Legal Aid Cell - subject to terms and conditions. 2. Can she be evicted ? No without adoption of DUE PROCESS OF LAW. 3. What are her rights ? She is having Equal right in Property. Pl. ref. 2004 SC judgement to the effect. more

Since the property is in U.P. It will be Allahabad HC. I am a lay person, any suggestion where I can read about this Section. more  
1. It is not a Section. It is a mandatory Article in Part IV of Indian Constitution. Article 39- A. The State shall secure that the operation of the legal system promotes justice, on a basis of equal opportunity, and shall in particular, provide free legal aid, by suitable legislation or schemes or in any other way, to ensure that opportunities for securing justice are not denied to any Citizen by reason of economic or other disabilities .

Supreme Court directive Judgment AIR 1987 SC 1087 “ 1. The Court held that the poor in India can seek enforcement of their fundamental rights from the Supreme Court by writing a letter to ay Judge .” Further , “ 2. The Court also held that under Art. 32 it has power to grant remedial relief which includes the power to grant compensation in appropriate cases where the fundamental rights of the poor and disadvantage persons are violated . “ 3. The Court held that the Court can appoint socio-legal commissions or devise any procedure and forge any tools it deems appropriate for the enforcement of fundamental rights of the poor “ .

you can quote the Article while urging Chief Justice of High Court through a Letter. more  
Mother's Property shall be devolved only on Females. Sons cannot claim. Father's Property only is subjected to devolution among all Children. JUSTICE MUST BE FOUGHT FOR. more  
After getting suggestions from this Advocate , Petitions to be filed with (1) HC CJ requesting Justice under Article 39 A (2) CM for both Legal Aid and Financial Assistance .

It's necessary and not to be left off . And you also know the next course using a Media House. more
