Domestic Violance

My son who is settled in Bangalore had married to a girl in Delhi through contact in Facebook & further communications. We parents who lives permanentlyin Kolkata, had given nod and attended hindu rituals at Arya Mandir at Delhi followed by reception at Kolkata. Then they started living in Bangalore. We parents visited them once in a year. At Bangalore, going by bahu's desire, we were forced to take vegetable foods, though at Kolkata we eat non-vegetarian foods. We didn't shown our displeasure, because we visited them for short duration. This happened in 2015,2016 & 2017. Now after 4-years my son wished divorce on mutual consent for which we are remaining silent, because we have no role in their personal life, neither they have asked for our intervention.Now bahu has filed a domestic violence case against my son and also involving we parents with fictitious stories. Our simple contention is that we live in a different town and had never intervened in their personal life living in a different city. Our communication to bahu was limited to new year wish, Diwali wish & marriage anniversary day and small money to have good food on those days. I wonder whether learned judge will summon us or serve arrest warrant to parents living in a distant city, who had never involved in their married life. Can someone from legal precession suggest, as how to keep ourselves safe from them and not dragged into their divorce proceedings. more

NO. You can't be a party to the litigation. It is the Usual practices of this sort Now a days, mainly of NORTH INDIANS. Abstracting the money by abuse of legal process. Pl. ref. the SC judgement to the effect that In-laws staying away - be speared and con not be a party. Moreover, the mutual consented separation is good thing, let it takes place so that your son can start his new life and you will also get re-leaved. more  
As you are not residing with them under one roof you are not subjected to your daughter in law's allegation.There is no arrest in this case. First You will be summoned and you have to present and your lawyer can plead that parents are be out of this allegation and never subjected her harassment. more  
sorry to say, but this is absolutely wrong thinking. In our case ,without any 2nd thought, Bangalore police registered the FIR ( they are now expert in filing FIR in false DV cases).. They even did not sent a notice to us for our views/ clarification. We managed to get the bail but the 4 best cases ( meant for women protection) running behind us since 3 years and no near future end. so all those who has given interpretation that your name will be quashed , are night mare ... be prepared for sleepless, mental trauma .. more

Knowing our Judiciary which is actually and Industry run by Lawyers (executives) headed by CEO (Judges), even false and fabricated cases go a long way in ensuring collections at the box office to fill the pockets of Lawyers as also Judges (short cut). Ever wondered why cases take 20-30 years to be disposed off? They suck the last drop of blood to leave you high and dry. So brace yourself as your Bahu's Liar will throw more garbage and shit on you then you would have thrown in the garbage bin in all your life. more  
You wrote the reality of Judiciary in India.... upto my 59years, am yet to see an ethical lawyer or judge! It's our fate! more  
For false cases if they r not able to prove there should jail terms in judiciary, all pending cases will come down. more
