DEFICIENCY IN COURIER SERVICE - REMEDY
We as a Proprietary concern had taken the service of Fedex to get a shipment from U.S.A. We had filled the Fedex form and instructed the material to be delivered at Chennai Port, from where our agent would clear the material. The customer for whom we had imported the material enjoyed exemption of customs and other duties at Chennai port. The courier, right from picking the material made mistake in entry. The mistake was pointed out immediately, before the material left the warehouse of Fedex U.S.A. They assured to correct the mistake. When the material entered Indian territory, we found that the material was been sent to Bangalore. We again alerted Fedex India. But no action was taken. The shipment was sent to Hyderabad airport, where the shipment go locked. Fedex kept on assuring us that they will ship it to Chennai. But later showed their helplessness. As a result the insurance we had taken, which was from U.S to Chennai port and from Chennai port to The customer premises, when defunct. The customer had to bear lot of other difficulties in clearing the shipment. It took almost more than 4 months to get the shipment cleared. For all this time our payment, which was quick huge, got delayed. Also the customer imposed a penalty on us. Now Fedex is claiming that they have the right to take the shipment any where as per their convenience.
Please advice how we can claim damages from the courier for negligence and deficiency is service.

The astric mark stating the terms and conditions applied is more alarming as it restrict the responsibilities and liabilities of the Courier Service provider. BUT you can complaint the consumer Forum for negligence's and deficiencies of services. You are having valid and good points. more

FedEx local agents are the worst. Once one of my friends sent some gift for me from USA, it reached Mumbai and FedEx informed me, by mail, that some custom duty is payable so I should come to Mumbai. I told them my nephew would come. When he rang up they asked him to come but when he reached they claimed that the consignment is lost and informed this to their US office, who refunded the value to my friend. However it was obvious that someone at FedEx pilfered the same. Never trust FedEx when calling anything to India. more

The base level people with courier firms are not that educated to make all entries correctly. Similar experience gave us a treat but with due follow-up things did materialize favourably. Some times believing the system helps. more
