Clarification required for Relinquishment Deed( Ladavinama)

Is Relinquishment deed or Ladavinama valid as per Law?
One of my property is not registered but having a Relinquishment deed (Ladavinama) which had been executed between property owners and my father. At that time my father purchased the said property and executed Ladavinama but not registered. Now my father had expired and the successor of the property owners(died) are claiming on that by stating that the Ladavinama is not valid as per law. But the possession is still in our hands and paying rent as well. Plz advise what should we do in this scenario.

Since you are in possession of the property and even paying rent, nothing to worry at. As you can not be dispossessed from the property without due process of law (filing a case in Court), the opposite party will have to file a case in Court. It will be very difficult for opposite party to succeed in court. However it was fault on the part of your father in not getting deed registered. But now nothing can be done. However you are at advantageous position. All the best. more  
Relinquishmen deed is a valid document as per law. i hope the Relinquishment deed you are talking about is registered. By virtue of such deed a person relinquishes his right in favor of all other persons having right of ownership in property. A common mistake is when person relinquishes rights in favor of one partiular person. Such relinquishment deed is actually a gift deed in law despite the title of relinquishment deed and shall attract charges on gift while registration. Relinquishment deeds do not mention consideration amounts as they are made out of love and affection. Contact an advocate and show him the relinquishment deed. more
