Claim settlement issue in household item shifting
Hi, I shifted from Delhi to Pune and booked a Packers and movers name Cargo India Packers and movers in month of Jun-16. They assure me to safe transportation and for the same they also charged an amount in favor of insurance from New India Assurance(That I have not received till today). During transportation so many items got damaged and i had to spent to much money. When I asked for claim initially they declined after so many calls every time they are saying we are asking to company and not doing anything. Concern person not picking calls also.

If you have the LR and the policy number of New India assurance co. you should contact them for redressal. I hope you got the signature of the one who delivered goods to you about the goods being received in damaged condition. The articles have to be inspected by company surveyor before any claim is settled. If you have not been give3n any policy number, as I suspect, then they might not even have insured your goods. Generally insurers do not give insurance to the carrier favouring the consignee. Either it is given to the consignee directly or the transporter gets insurance against damage claims by consignors, if they are bank approved transporter. more

Ashok Gupta ji, Pl go to the consumer court after writing a factual letter to the Transport and Insurance. Hope you hv receipts for amounts paid to the two. Hope You hv not discharged the trucker after delivery....hv u mentioned the damages or damages would be intimated later. I had a problem in 1994 with my goods but I wrote out everything on the reverse of the discharge/receipt to truck driver. I filed a case in CC, Dadar Mumbai and before the case commenced gave me a compensation of Rs 6500. Deepak Packers, hyderabad. Hope this helps. more

I think, it will be difficult for you to prove that the damage caused was in transit. Those people will ask some proof to prove this. more

Thanks Virmani jee for endorsing my genuine COMMENTS; I have all the docs.provided by the bank-in fact these are the facts attached with my case in the district Lok Adalat,which looked in my favour from the beginning & that especially after the Remark made by the Justice after watching the CC TV footage by him; Maybe I can not say more loudly fearing A contempt case, but as already stated-AGGRIEVED by the sudden turn of mood by him and not quoting any thing about CC TV FOOTAGE seen by-the court, I did go to Hogh Court w/o any RELIEF,as stated;Spent already, besides the loss of 30 K(There was no typographical mistake in my statement), & w/o any hope left in the existing Curseable-SYSTEM, that I had no other option except to 'given up' attitude, till provoked (Dukhti-Rugg), by the chatting in the case under debate; In USA -now & shall meet you on return,if desired,Pl.(some of d docs not wd me-here pl.) more

you just have to do two simple work one please check the recipt which has been given to you if there is any charges for insurance for your assest is mentioned or not if yes then you will get the claim at any cost. The second step is do a legal case in consumer forum against the company and make recipet the base of the case and you can write a application to ssp and station officer describing your case ,next send copy of recipt and the case file to both the officer and then send the copy of the same to the company mentioned above stating that you have send these copies to following authorities more
