City Corporation, Kalburgi (Gulbarga)

Hello everyone,

My father was a Doctor and was serving as The Health Officer for Gulbarga City Corporation (now known as Kalburgi City Corporation), Karnataka. He passed away due to a illness in his service period. At the time of service, he had been allotted a residential site in the city from Tehsildar. After his demise, it was again allotted to my mother in the year 1990. Since the we have been asking for the physical handover of the property but initially they (Corporation) said the site is under court case and will take time. In the year 2013 we have paid the tax for the site since we had the documents with us. Then we applied to a permission for constructing a house on the site. We did get a approval. But again we raised the same question, where is the physical location of the site? Again they said its under court case. Then we applied to a RTI seeking the truth and the court case number. Even after two months we did not get any reply for our RTI application. We sent a reminder letter for the RTI, but no reply again. Every time we approach the Corporation Commissioner, we are asked for some time and after some time a new commissioner is appointed. Same story repeats...

We do have all the documents from the City Corporation Gulbarga, Karnataka.

Please advice me on whom to approach on this issue.

The tax receipt would stand as a proof for you to contest the claim. Law is on your side.Consult a good lawyer. The reason of not replying to your RTI lies here. Again file a fresh RTI and wait for Reply and excercise your right to get reply/ documents from Appelate Authority. This shall strengthen your case. If you dont get reply from CPIO you have almost won the case. Now they are fearing and taking advantage of your ignorance of RTI rules! Do not accept to built house on half area till you get reply from Appelate Authority. In your RTI application clearly mention how much land area was approved to your mother, the letter no, despatch no, receipt no etc to nail them. Good Luck. Go ahead. more  
Dear Mohan Sir!, The document clearly says that my mother was allotted the complete site. After a oral confirmation from the officials (saying that we would be getting only half site), we had requested detail via RTI if it the allotted land was reduced with respect to a court order. Sir! please tell me if the land was divided by the court, why did they accept the tax from us for the complete site? I mean, should they accept such payments and also give us permission to construct the house? Please correct me if I went wrong. Thanks Sir! Pankaj C more  
Dear Mr. Pankaj, Verify your earliest documents which say your mother would be given land and how much. In that document see how much land you/she would have received as mentioned in it. Taking this as your base and right of getting land you can proceed further. Means you can challenge the authorities saying how they have reduced the agreed land area unilaterally. Since this matter is other than under RTI you have to seek advise from say advocate and also a person who can guide you on property matters. The land allotment matter is other than under RTI perview. more  
Dear Mohan Ji, Thanks for your review. I have contacted the Commissioner of the City Corporation (IAS) regarding the issue. He has handed over the case to his P.A. I spoke to the P.A today over phone. He says that the Corporation is ready to give a site which is half of the dimension of the allotted one. Reason being same.. "As per the court order". I have told him that I have asked for the details for the court case via RTI (no response). I also mentioned that till 2013 I have paid the tax for the complete allotted property (which I think they should not have accepted it if the site was converted to a lower dimension). Also I had received a Khata extract for the same. Then later I applied for a permission for house construction on the complete property. I even received a permission to go ahead and construct the house on the property. Now they are saying that my mother would be getting only half of the site!. Please advise me on this Sir!.
