City Corporation Gulbarga, Karnataka

Hello everyone,

My previous post was deleted! dont know why. Hence posting it again.

My father was a Doctor and was serving as The Health Officer for Gulbarga City Corporation (now known as Kalburgi City Corporation), Karnataka. He passed away due to a illness in his service period. At the time of service, he had been allotted a residential site in the city from Tehsildar. After my father's demise, it was again allotted to my mother in the year 1990. Since the we have been asking for the physical
handover of the property but initially they (Corporation) said the site is under court case and will take time. In the year 2013 we have paid the tax for the site since we had the documents with us. Then we applied to a permission for constructing a house on the site. We did get a approval. But again we raised the same question, where is the physical location of the site? Again they said its under court case. Then we applied
to a RTI seeking the truth and the court case number. Even after two months we did not get any reply for our RTI application. We sent a reminder letter for the RTI, but no reply again. Every time we approach the Corporation Commissioner, we are asked for some time and after some time a new commissioner is appointed. Same story repeats...

We do have all the documents from the City Corporation Gulbarga, Karnataka.

Please advice me on whom to approach on this issue.

Hi All, In addition, we had applied for house construction on the said property. We had also received a reply with confirmation saying that we can start the construction!!. more  
Thanks Mr. Uday. I have all the documents with me. Also, I have paid the tax for the said land till 2013. The officials site 2 reason at different time. First being, the land is under dispute between the City Corporation and the original land lord from whom the city corporation has purchased the land. Second reason being, the courst case has been solved and as per the court order, my mother would be getting only the half site instead of the full site as per the allotment letter. If this is the case, then why did they accept the tax? Also, they have provided us with the Khata Extract which clearly says that we have rights on the full site as per the allotment letter. They are not ready to respond to our question on the court case. Thanks Miss. Brindha, We are not confirmed if the land is under a court case. We did not get any document stating such details even after filing RTI demanding for such detail. The property was given to my father by the City Corporation and later it got transferred to my mother. more  
1. "allotted a residential site in the city from Tehsildar" must have the relevant details. Else you have to trace them out first. 2. Secondly find out what court case they are talking about with relevant details. Else it is only the Procedural Hurdle or Excuses of "Babu". 3. "physical location of the site" if the allocation details are available you may approach with it to Land Record to find out the "Four Corners" of your allocation. 4. Last but not the least - to keep all this hassle at rest approach to HC for Writ with all relevant facts and doc's. more  
When a person takes a loan they are advised to inform the same in the registration office. Similarly if any case is running whether they would inform the register office to note the same to avoid getting any supportive papers or to avoid selling that property. Did you get your documents from city corporation after case was filed or before that. If the documents you received was after the case was filed then you are making the employee to get into the trouble. Whether the property is your father's or given by the government?? According to my knowledge, when any property is given to government staff, after their turn they need to hand over it to the government. But many are not handing over then how their successors will be allotted house. This is what happened in the case of Mr. Abdul Kalam also. His well wishers asked the government to change his house to the library, but as it was government property & it was allocated to other minister which was really good decision by the government. Abdul Kalam has contributed more but when we compare it with freedom fighter, what we are doing for them. In 90's, the situation is very much different their is lot of document problems in giving the government property to the people for just utilizing it during the period of their work and if need the property can be enjoyed only by his wife, I don't thing it can be inherited by the children.
