Car parking facility in a housing society
My group housing cooperative society in Delhi has less than 100 car parking slots for more than 200 flats. I understand in such situations the law treats as a "common area" and provides for the facility to be shared by all residents. But our society's general body has taken decisions to allot the limited parking on the basis of first-come-first serve basis, so that those members who came in to reside here later do not have the facility. I would much appreciate to be advised as to what exactly the applicable legal provision is, and what the recourse is. more

NORMALLY CAR PARKINGS ARE SOLD BY THE BY THE BUILDER AND NOT BY THE SOCIETY IF THE CONVEYANCE IS MADE THEN ONLY SOCIETY SHALL BE ALLOWED TO ALLOT THE REMAINING ON CERTAIN WAYS/METHOD LIKE BIDDING ETC more

It is absolutely illegal for RWA to rent out or auctioning out the free space in a society for whatsoever purpose.It goes smooth as long as somebody does not questions. It is obvious how any body can sale or rent out without having ownership rights. The RWA cannot have the ownership rights as per their Constitution or Memorandum of Association submitted to the Registrar of Society. more
