Car damage claims

I want to understand what is the recourse one should take when your car is hit by somebody else's vehicle and it was clearly not your fault. In most of the cases the company transport vehicles drive rashly and the driver is generally not the owner of the car. How should we pursue such cases and make sure that there is a meaningful settlement. more

If you have a valid insurance package, you are eligible to claim damages for loss caused by other. That's why we insure. Your package should have own damage and third party. so your insurer pays when you damage your own car, other damage your car and also when you damage others. Similarly when a third party has damaged your car without any default on yours, you have option to claim with your own insurer or that of the third party's insurer or individual. In any of these cases, you need a FIR. more  
Special damages also include vehicle damages and it can be filed by way a special petition  Special damages pertain to one which has to be specifically pleaded and proved and it consists of out of the pocket expenses and is generally capable of exact substantial calculations and in a claim petition we can seek only special damages or special and general damages. In the Legal parlance the SPECIAL DAMAGES are normally a). ACTUAL LOSS OF EARNING b). MEDICAL EXPENSES c). FUNERAL EXPENSES d). LEGAL EXPENSES INCURRED Further for the query of hariprasad Shetty, the Claim can only be fined against the owner of the Vehicle whereas the Driven can be booked under criminal act for his rash driving. more
