Vishal Ji I presume you are referring to divorce proceedings pertaining to mutual consent. Else other divorce cases (contested) run for an average of 3 years - with atleast 2-3 hearing per month - again depending upon the case. Mehrotra Ji it looks like you have filed for a "contested divorce " -the circumstances you have mentioned under which you left certainly does not give room for mutual contest divorce. How old are the kids? who are the close to - you or your wife? Depending upon their age they have a right to stay with any of the parents - hence it is important to know who they are close to - even of the issues you are mentioning I doubt if out justice system would give you the custody of the child if the child wants to stay with the mother. Suggest you do a good research and if required ask your friends for a lawyer (good one specializing in divorce or if you go to delhi there is a firm which only deals in divorce area) and then hire a lawyer after quality consultation. Ministry and police are hardly going to do anything - I guess they are too busy on other areas (which we are all aware of ). In respect to one of my colleagues, sir filing of FIR is not easy as police refuse to do so point blank - period. Public demand through their elected Legislators for making the Directive principles of Rule in India , the part IV mandatory as part III which was just Honored in script in the Preamble of the Constitution in 1992 . iv. The then P.M. Sri V.P. Singh proposal and Supreme Court conclusion of implementing Economic Creamy layer in the application of Reservations and Relaxations in 1992 - 1993 that eradicates the poison and rivalry of Caste and different Religion benefits of lively hood and Family Concern and Concept . 6. All the above 5 issues in addition to the recent intentions of following ; Lovers Day ; Pub Culture ; Kiss of love ; and, ; Joyful Weekend Events ; etc., lead towards development of different attitude in the Society to live and lead easy , Joyful , Luxurious , Wealthy etc., etc., the effect of which really ruining the Families of Certain Town and Cities where the T. V. MEDIA HAD THE PRACTICE OF ODD ADDS ; MISLEADING ADDS Etc., besides the very Internet Facility with the hand phone i.e., the Cell . more  

This seems to be a very peculiar case where the children are abused by mother.But this must not continue. What was the reason for filing divorce? who has filed, you or your wife? Was it on mutual consent. why has not divorce been granted till now? What are the allegations against you by your wife? Whatever be, the children are innocent and should not suffer.Hence , first ask for the custody of children for the safety of them. more  

You don't need evidence at the stage of registering the FIR. That is for the police to inquire and gather. Draft a complaint disclosing all the relevant facts including the burn marks on your child's hand. Also, mention the names of neighbors or domestic help, who have witnessed this. Also, petition the court to take custody of the children. What matter is pending in Family Court - Divorce Proceedings? If so, you can file an application in the court to expedite the disposal of the case. As per law the divorce proceedings have to concluded within 6 months. more
