Last year I had booked a property in Noida Extension with following details.
2Bhk flat of 975 sqft on 10th floor. Tower no 10.
It was agreed with broker that I have to pay 10% of booking amount within given time (approx 60 days) and builder will issue me a cash receipt of 5% which he will take from me during possession. By doing this I can get bank loan on the property. I paid 10% as agreed by June 15, but later builder refused having such deal. Forcefully I had to arrange and deposit another 5% as they refuse to cancel the booking. For this property I paid ₹ 4.86 lac as down payment till Aug 14.
Now the worst part of story after paying 15%, I applied for bank loan but bank refused to fund me on this property as the builder was not authorized to construct anything above 9th floor as they haven't paid necessary due's to authority. Since Sep 14 I'm keep on trying to get my money back , with help of some known person I could get 2.5 lac from them but now they are not ready to refund anything. I have submitted all docs required by them including NOC from broker but they are not listening to me. Whenever I'm lucky to get them over phone they says "your money will be refunded at the earliest" but don't know when they will give.
I request members to pls guide me as what action can I take to get my money back.

I seek one more advise. I'm staying at Gr. Noida, property booked at Noida Extension and builder office is in Noida. In which location the FIR to be registered. more  
Thanks for your detailed and positive reply. I'm in touch with builder since last 7-8 months and have all mail communication,sms data saved with me. Have sent almost 19 mail reminder to them. In 4-5 of there reply they confirmed for refunding my money but not giving any time line. more  
Mr. Sanjay, you have a strong case legally for refund of your money. But keep in mind that legal recourse requires significant effort and takes time. In addition if legal action is filed jointly by multiple effected parties, it is much more effective. more  
I have not paid anything to broker. Entire amount was paid to builder with proper receipts. Even I have builder buyer agreement. It was a trap as I forwarded my loan paper to DHFL bank who on builders pannel. Bank also came to know after this. more  
I have got the post dated cheques for the principle amount and interest at 9%. I will deposit the cheques in May 15. Hopefully these will get honoured. Parasvnath the builder cannot afford bouncing back of these cheques more
