As I had mentioned earlier, the option is to see things positively. I am sure the backlog of cases is not a problem, which cannot be solved. With determination and dedication from the Judiciary and the Govt. it can be solved. The number of judges, wherever necessary, should be increased. Let us (for the time being) keep the disputes on appointment of judges on the sidelines. Let the Collegeium continue to work a in the past. Though the issue is important, the primary requirement of the common man is to get a verdict on his disputed matter. The NATIONAL AND STATE LEGAL SERVICES AUTHORITIES should be revamped. It is not properly and judiciously used. Many judicial officers use it as a luxury. Take the advocates also into confidence and set up ADALATS, fix quota to them (unlike the present system of "engaging" retired judicial officers many of whom are not interested in spending more time and settling matters) to complete the quota. Fix atleast 50% of cases posted in ADALATS should be settled. They should work atleast from 10 AM to 4 PM, unlike the present 'adjustment working hours' of 11.00 to 12.30 PM. I am sure thousands of simple cases including bank loan cases can be settled to the satisfaction of litigants. (I have seen it from experience). Let there be a genuine effort from the Judiciary itself. We have enough and more resources, we just don't utlise it. The present Govt. can do it and I feel they should do it. more

I agree Swarna ...in fact slightly deviating ...if responsibility and accountability is placed on three of the key platforms for India's development i.e. Justice, Doctors or Health and Education, our system would improve ...its not just about justice ...I am working on the higher education system of India as well as during this process also meeting medical people ..some of them are my friends and some a part of my professional contacts.....all of them feel likewise.....they feel and I second them ...there are good people...but most of them have twisted our various verticals to an extent that it not just one vertical or the justice system but the other two more  
Yes I agree with your suggestion and also know that unless some thing like NJAC is in force, and at least in Judiciary only merit matter in the appointment, until Uncle Justice system prevails, your suggestion even if it all accepted in the remotest possibility, it will be a cosmetic, redundant rule. Whenever Judges orders are reversed in higher courts, concerned judges should be penalised. In all organisations, persons taking wrong decisions are penalised. Why not judges. This is a British legacy. If judges too are made accountable, situation will change drastically. more  
This the reason, why High Courts are having so big back log of cases. Lower Courts do not want to take any chances, they just play safe and do give decision that is not accepted by wither of the party. more  
By-passing the Aptitude, attitude, Virtue, Merit etc have caused deterioration of quality of Public service system from Yuwang Swang time and it has been rolling down hill from Arabs invasion and treacherous entry of East India Inc to modern day veiled anti-dynasty to Nasty Dynasty grabbing Power to grab & loot Public wealth to leave their own children to survive a life full of FEAR to survey only paying protection money.Merit, attitude, aptitude, Virtue alone should be the criteria for any Employment (Service, Read Mother Theresa inclusive), foreign funds flowing to NGO to crack Bharath, sectarian divide and conquer Mad fit only to be in ICU of Mental Asylum.
