I am grateful to the former Judge for sparing time to make comment on my posting. I do appreciate that a Judge has to apply his judicial mind to evaluate the issues involved but I believe that in most cases his valuable time gets wasted if he has to be involved in allowing service of summons and even hearing deposition on either side. He may pay attention only to make study and appraisal of the issues raised on both sides as presented.
I believe that in processes like the following online filing and delegation to the Registrar and Commissioner may be possible and desirable in most cases in the interests of speed of disposal without sacrifice of the essence of the judicial proceedings: issue of summons, filing petitions, counters, recording of deposition, adjournments where essential and unavoidable, issue of authenticated copies of judgements, orders etc.
I am aware and concede that in the Statutory framework as it currently exists much of what I believe and propose may not be possible while at least whatever can be done may be put into practice.

Very good proposal.The harm done by the inordinate delay is much much more than occasional foul play or injustice that can happen in case, it is summarily tried and decided. more

I agree with Mr Pillai; quality of judges is low - not because of the lack of integrity of the judges but there are people who are stronger than the judges, I mean 'stronger' because these goons can harm the individual who is a judge; like any other human being the Judge also has to succumb to the vagaries of the powerful; protect the people from the goons. then see the quality of our judges; they are willing to perform but they are part of the society where goons prevail; who is asking for postponement of cases? how many times can an officiating judge allow postponement of hearing? Unfortunately the law is loaded against speedy trials; this we must concede; change the laws for facilitating speedy trials; but what will happen? justice gets scuttled; it will be like khap or katta panchayat; did you or did you not?and accept the words of the litigant or the defendant, as per the mood of the judge; we should be ready for this. No investigations; the actual culprits are the lawyers of the defendants, who play all the tricks up their sleeve and try to delay the proceedings, and the poor judge has very little say in this matter - because the constitution and other laws give this privilege to the litigant. Yes it is not that there is no solution; let all the pending cases be reviewed by a team of lawyers and judges and cases remaining pending for want of proper evidence etc and pending for a long duration be identified, they need to be closed summarily in the presence of the parties involved. where the parties do not appear, then the case must be closed, as untenable; Yes, it is possible that some foul play could come up in the proceedings; but this is better than keeping the cases - be it civil or criminal, pending for decades; more
