My father is having Bank FD's in joint name ,but now he has demised ,but still the deposits are continuing in his name as Ist holder and ITR is filled , but he is not having AADHAR CARD . As PAN to be linked with AADHAR Card & it shall be made mandatory for filling ITR ,AADHAR CARD details to be linked even for filling tax return of FY 2016-2017 . Please advice what shall be the procedure for filling the return as non linked PAN Card shall be null and void. Thanks

The advice given by Mr Goyal is correct.PLease file return for 2015-16 before 31st March,as legal Heir.Further the F.d is to be transferred to his legal heirs as per his will.If no will is there than the amount goes in equal proportion to his First Class legal Heir/or in the name of specific person after receiving no objection from other living heirs more

You cannot file a return in the name of a dead person as he has lost his entity of a living person the day he expired. The FD should be transferred in the name of his heirs as per the law of the land. Get the FD transferred in the name of the second joint holder and file the return of the joint holder if his/her income is taxable. Do not do any thing against the law other wise who so ever files the return in the name of the dead person can be punished as per law. more
