LEGAL GUIDANCE AGAIST BUILDER
We have purchasd a flat in " SIDDHIDHATA ASTHA " Apartment situated at Village KUDASAN, near GANDHINAGAR, having 5 towers, A B C D E F, each having 20 flats, total 100 flats.All the members have paid different amount as per the broucher, which contains GUDA Charges, Electricity, parking,Maintanence harges, garden, gym, generator, theater, lift, security, CCTV Etc.We have paid these different charges but he has not given any receipt for this. He has discontinued paying all maintanance charges and we got our eletricity disconnected. In the initial stage, our builder was very much co-operative. We approximately 70 occupants have got the possession . Builder has not provided any list of the flat owners... Builder has disappeared since two years. He is not paying any amount to us. We were compelled to form and register a HOUSING SERVICE SOCIETY ltd. We are facing finaical problems. We collect some money from members and manage the show.
My request to you all friends is what legal actions can be taken against this builder ??? We are unable to trace his whereabouts. Registered letters are returned by postal authorites with remark " not found"

CASH PAYMENT TO UNTRUSTWORTHY MEANS " USKO TIL PANI CHHODDENEKA ".If there is no receipt with name signature and stamp of the company. more

When we pay cash it is our right to have receipt. Otherwise give ONLY a/c payee cheque. Beware that payment of cash above Rs.20,000/-is invalid as per IT Act.Further all your payments/receipts are watching by IT departments. more

I am sure some of the members must have paid by cheques, Bank statements is a valid receipt to the effect that all other payments are also made. Suggest Remedies as 1. Cheating and such other clauses - Police Complaint. 2. Consumer complaint 3. Civil Court Remedy. No Need to trace him out as the RPAD letters with Postal Stamp is good proof to proceed ahead. Consumer court can also be requested to Publish Paper Notice. In case of Cheating and police complaint - it is the Police Dept will find out the criminal/culprit Civil Court to get your money back. more

Please collect details and records of payment made by every flat owner and the society, You may file a case in court on charges of breach of trust and deception on behalf of he society. This will bring the builder out in the open and get prosecuted. Please check up your agreements as to maintenance of buildings and amenities until the builder hand over the possession of the building/ flats. more
