Most of the delay in disposal of judicial proceedings appears to be due to the Advocates. It was laid down in the Amendment enacted in or around the year 2002 that not more than three adjournments may be allowed. Judges have been liberal and allowing more than three adjournments and no Advocate appears to be filing Appeal against allowing more than three judgement because all Advocates seem to benefit from liberalness on the part of Judges even though that involves violation of the Law in force.Time is sought even to file Counter-affidavit which contains mostly denials of the contents of the Plaints/Petitions (whether justified or not). Lawyer use adjournments to indulge in extortion of clients. The High Court too does not object to more than three adjournments because the High Courts themselves do not disallow unjustified adjournments sought from them. It is suggested that a Senior Judge may be posted as Review Authority with jurisdiction over about ten Judges and responsibility to keep watch over violations of Law and take appropriate acton. more
Bar Council's Dutiful Responsibility lies in all such issues as well as the failures by Policing.
All these are open secrets but Cognisable too.
