Real Estate Consumer Grievances - Inputs on Solutions

Based on your inputs, below is a summary of root causes for grievances in the Real Estate sector.

Please review them and identify solutions to them. We will then compile all three Issues, Root Causes and Solutions in the form of a whitepaper and submit to Government bodies for action.

Consumer grievance in Real Estate – Root causes
1. Corrupt nexus between builders and government officials
2. No laws against cash transaction while purchasing properties
3. Builders provide discounts for cash deals
4. No laws against the false promises that builders make to dupe customers
5. No penalties charged to the builder for not completing projects on promised time
6. The builder cannot be held responsible for anything that happens to the house after possession (substandard quality of construction etc.)
7. Lack of an independent regulator
8. A lot of raw material is sourced from the local un-registered vendors, who don’t understand quality control, legality, taxes etc.
9. Government officials are bribed for not reporting non-compliance of building laws
10. Most of the projects have political/criminal backing. Hence people are scared to go to court against them
11. Non availability of a dedicated forum to redress the grievances of customers pertaining to real estate
12. Lack of awareness among customers more

We all know that there is an illegal nexus between builders, Govt. officials and Politicians. We have very glaring examples all over India!! There should be accountability at every stage from every authority/person/Estt. Builders should not be allowed to announce projects, unless it is cleared by all concerned agencies..They have to guarantee certain things before collecting money from the consumer... etc. etc. more  
1. Without the BASIC APPROVALS from the SINGLE WINDOW Clearance Authority , NO BUILDER should announce the Project. 2. Any Court intervention after that, if any ruling goes against the Project, the Approving Authority should be HELD RESPONSIBLE. more  
Solutions are suggested below 1 Corrupt nexus between builders and government officials: Real Estate authority be introduced to fix the land/flat/building value of each places and the transactions from the buyer and Builder be routed through this agency . All transactions should take place through cheque. If the land/build/flat value is shown at a lower price to get a less registration fee and if it is found at a late stage, the authority should have the power to take back the property from the buyer with the price quoted in the Registration Deed. 2 No laws against cash transaction while purchasing properties. Law should be made against cash transaction and the registration should take place only after witnessing handing over cheque in front of the Sub-Registrar 3 Builders provide discounts for cash deals. Not applicable in view of the above suggestion 4 No laws against the false promises that builders make to dupe customers . Builders should be allowed transaction through the said authority 5 No penalties charged to the builder for not completing projects on promised time . The projects should be inspected by the said authority and thereafter only the payment is to be effected by stage by stage duly certifying the value of the portion/structure completed. 6 The builder cannot be held responsible for anything that happens to the house after possession (substandard quality of construction etc.) The quality of the flat should have the joint responsibility of the builder and the said authority. 7 Lack of an independent regulator The proposed authority will regulate. 8 A lot of raw material is sourced from the local un-registered vendors, who don’t understand quality control, legality, taxes etc. The procurement of materials be dealt in consultation with the authority through public auction. 9 Government officials are bribed for not reporting non-compliance of building laws The authority should have the full control and it should have semi judicial power 10 Most of the projects have political/criminal backing. Hence people are scared to go to court against them The authority should be kept away from political affiliation 11 Non availability of a dedicated forum to redress the grievances of customers pertaining to real estate The customer grievances will have to be dealt by the said authority 12 Lack of awareness among customers The customers should approach only the authority and not the Builder directly.The builders have to register their property in the Authority and in turn the authority will make advertisement about the availability of flats. more  
1. Please have a standard Builder/Buyer Agreement , which is approved by the Regulator/ Any Authorized Body. more  
The criminals involved in cheating the people in Real Estate cases should be severely punished and all their wealth should be confiscated. Such cases should be tried and the judgment delivered within a year including the appeal. more
