Real estate construction delay

I have purchased a flat while its in construction and paid the entire amount (by availing loan ). As per the schedule it should complete in 2014 September but the work not progressed even little bit. After having many follow ups I managed to get a compensation letter (he gave me the letter to pay the rent amount at the time of flat possession and the amount will be adjusted towards final payment from me). The tenure of the letter expired in 2015 September but I have not got the flat and the construction situation not improved a bit. He is planning to issue one more letter but I refused to take that and I asked to pay my EMI or give me a letter for revised compensation letter with strict flat possession date etc. I am exploring options to get back my money. The sales agreement having lot of reasons for delay in which case builder is not liable. Please advise me for further action. Shall I file case/ legal notice to get my money back. more

U made a mistake on selecting a stupid builder. Before paying to builder u should have studied his biodatas. The sale agreement was itself an indication that the builder is not trust worthy. These people with people they know peole are united, moreover they have support from local political people and gundas. file a case in consumer court . This should be a combined effort of all the affected people like u against the builder. U all affected people should charge the builder for the refund. more  
you are unnecessary accepting the letter. instead of taking letter you must pressurize him to give statement showing that my (due amount which was to be paid to builder) with this deduction. take a fresh statement of due amount with deduction. the letter will not solve the problem. you are clearly telling the period is also expired. the best method is take a fresh letter it should contain the details of rent deducted from due amount and when the flat will be handed over. keeping all these letter it will be useful in future more  
Do I need to pay any amount/charges to the builder if I loose the case? more  
Explore under new act which is hardly 1 month old take a opinion of some legal experts than perhaps something may come up. more
