I presume Mr Ashish Shah is mixing up service tax with service charge. Service tax is payable on each restaurant bill, which is passed on to the government by the restaurant owner. There is no option in this regard. In addition to service tax, the restaurants are also charging additional 10-15% as service charges, which has been made optional, means, the customer may or may not pay that amount of service charge. It is pertinent to note that service charge has not been made illegal and question of taking punitive action will arise only when the customer is forced by the restaurant to pay the service charges against his will. more  

Government has already notified the rule and a complaint should be filed. more  

Service charges @6% are still levied along with GST by Restaurants whereas Govt orders made service charges optional ,if customer want to pay service charges may be added to the bill otherwise ignore. However if customer opposes charges are reversed as rebate.{This is my personal experience} .So one should check the bill before payment. Govt should again advice Eateries ,Restaurants etc not to add service Charges to the bills at their own and such Restaurants should be heavily fined. more
