Fine for GST over MRP

I understand many of the state enforcement officials are in this community. Can you guys please confirm what is the fine If a retailer is found guilty of charging gst on mrp??

Also how do you go about enforcement step by step? Like to hear from diff states esp UP? more

DONT PAY MORE THAN MRP, IF DEMAND ASK HIM TO GIVE THE BILL SEND THE SCAN/PHOTO COPY OF IT, TO THE COMMERCIAL DEPARTMENT THEY WILL TAKE CARE OF HIM more  
No need to inquire . What so ever the rate is displayed for package product is MRP and that is inclusive of all taxes. The only thing you have to check the MRP on the pack if GST is added after MRP, it falls under Unfair trade Practices as the price mentioned on website is considered as MRP for customer . They cannot hide any price from the customer. more  
All States shall mandate and make all Traders display the Rates of GST & their product for sale . This will help the GOI & people at large . All Traders are to follow the Returns fixed at the concept of GST and their Accountants to realize the concept of Quantitative returns that reveal the product Manufactured and , quantity being sold to end users/customers . THIS NOW, THE MAJOR DIFFERENCE BETWEEN THESE TWO CREATED LAKHS OF CRORES BLACK MONEY . more

There is no clear cut penalty described for selling goods by--if sold for price/ charging more than MRP however as per Section 36 of LM Act it falls under fine of Rs 25000/- for first offence . Section 36 states as Penalty for selling, etc., of non-standard packages.—(1) Whoever manufactures, packs, imports, sells, distributes, delivers or otherwise transfers, offers, exposes or possesses for sale, or causes to be sold, distributed, delivered or otherwise transferred, offered, exposed for sale any pre-packaged commodity which does not conform to the declarations on the package as provided in this Act, shall be punished with fine which may extend to twenty-five thousand rupees, for the second offence, with fine which may extend to fifty thousand rupees and for the subsequent offence, with fine which shall not be less than fifty thousand rupees but which may extend to one lakh rupees or with imprisonment for a term which may extend to one year or with both. Proposed penalty from 01.01.2018 for the compounding amount is Retailer is Rs 5,000/- and Rs 25,000/- for Manufacturer/Importer. more  
Displaying prices on net does not mean it is MRP. First please confirm that the displayed prices is MRP or exclusive of GST, then pay. more  
Yes, there was a statement from Union Minister for such proposal but the same was protested by traders. I am of opinion that there should not be any punishment as the officials will misuse the power and threat to traders for imprisonment. There must be effective monitoring by department and impose fine with due diligence without taking bribe. Cash memo to be compulsory even at vendors level and this the best solution to control Unfair trade Practices.
Jag Grahak Jago and make your habit to get receipt at the time of purchase even in plain paper with the name of outlet, Date, Item, signature, address and mobile number. Once you start asking such receipts, no vendor will dare to charge more than MRP and sell you expired product. more  
I think in TV debates from the govt side,were telling that from 2018 the punishment for higher selling price than MRP is Punishable not just by fine but Imprisonment,Can u c like arify more
