eCommerce mrp non-compliance

it is good to read that govt has not extended date for eCommerce companies to display MRP. I want to share that myntra and jabong must be thoroughly investigated by the department of consumers because both these companies are not only listing products with total disregard for MRP, they also levy GST on purchases.

Must be boycotted by all and corrected at the soonest and dept should make sure no inspector is letting them go inexchange for some money. more

Yes.it has happened several material.sometimes we are confused what is the actual price to buy.as there is heavy difference of SAME material in SAME place from shop to shop.specialy the cooking oil.chabanprash.from a good company. I do not know how it will regularised in a discipline.who will be control and who is the authority thanks.nk ghosh.. more  
Myntra, after legal vetting, says the following about GST : How is the GST amount decided? Following rules will govern whether or not additional GST will be applicable on the products purchased by you: GST applicability: For a product, if the fulfillment is done on or after July 1st, 2017 and total discount percentage is more than 19% of MRP, then GST may be collected from customer in addition to product price, post discounts. The discounts include those resulting from special offers such as Buy 1 Get 1 and similar offers. GST amount: If applicable, the amount of GST collected from customer depends on category Apparel/Clothing: Max 12% of net payable (MRP - product discount - coupon discount) will be collected from the customer. Footwear: Max 18% of net payable (MRP - product discount - coupon discount) will be collected from the customer. Home Furnishing: Min. 5% - Max. 28% of net payable (MRP - product discount - coupon discount) will be collected from the customer. Accessories/Other Categories: Max 28% of net payable (MRP - product discount - coupon discount) will be collected from the customer. The amount of GST shown at the cart level is a mere estimate. The actual GST payable shall be determined basis the warehouse (based on availability of the products) from where the goods are being shipped, which will be checked once the order is placed. Only in case of GST being lower than the estimate GST (based on the warehouse from where the goods would be shipped), the customer would be notified of the same and any additional GST paid by the customer would be duly refunded to the customer. more  
Sir, I would like to suggest you to kindly study the judgment of National Commission. This is not an advisory but is a judgement and imposed penalties. Much prior to the judgment, I had written an article on such unfair business practices which is available on my blog on SkVirmani+Jagograhak. I would request you to kindly go through the same. I am pleased to say that the reasoning in the judgments of State Commission and National Commission more or less agreed to the contention made by me in the said article. The charging of any tax (VAT or GST) on discounted revised prices which are again MRP is unfair and deceptive trade practices. I have not understood as to what is the significance of the discount mentioned in your comments and under what rules. Myntra cannot frame any of its own regulation but to follow MRP rules and MRP rules say no tax is chargeable on MRP and any discounted prices are also revised MRP. more  
Sandhya, No, I do not work for Myntra .. All my Info is from using their Site to buy different Items .... All this Info is on their Site !!

S K Virmani, National Commission has just issued an Advisory along with general Legal Remedies available .. including taking action against any one in violation of current rules.

It is just so surprising that so many Educated & Well-Read Persons are falling into the 'Herd Mentality' of following Some People who 'Generalise' any Incident into a 'Large' Case of 'Illegality' deserving an action under contempt proceedings !!

I would request All to personally use & then intelligently Compare Rates in both Myntra & Amazon before joining the Bandwagon demanding all sorts of class-suite Legal Actions, mainly due to some legal technicalities !

Let me however reiterate that I fully support the Demand that they must declare both 'MRP inclusive of all Taxes / GST now'' & 'Expiry' on all goods after January 8th as has been directed legally .... more  
LM officials should book Myntra immediately based on court judgements. more  
Whether the CONTROLLER OF LEGAL METROLOGY is in existance in India? I have not come accross any detection of case under this act. They are busy in making Rules only. more  
I also received telephone instrument MRP on the box is duly removed by cutting. more
