Dual MRP
The issue of Dual MRP for the same packaged water bottle of One Litre was on account of sale to Institutional Consumers. The amended Rules do not specify that for same commodity a different price is not allowed for Institutional Consumers.
In fact amended Rules will allow the dual pricing if 25 water bottles are packed in a box for supply to Institutional Consumers then Provision of Rule 3 will not apply to packages containing quantity of 25 Litres.
Rule 2A is worded " Unless otherwise specifically provided under any other law......" thus again providing a loophole for misuse of amended Rules.
Why Rules notified on 23 June 2017 are not being enforced from 1 September 2017?
The Amended Rules are reproduced below for ready reference:
‘(bc) “institutional consumer” means the institution which buys packaged commodities bearing a declaration ‘not for retail sale’, directly from the manufacturer or from an importer or from wholesale dealer for use by that institution and not for commercial or trade purposes;’;
3. In the said rules, for rule 3, the following rule shall be substituted, namely:-
“3. Application of Chapter.- The provisions of this chapter shall not apply to- (a) packages of commodities containing quantity of more than 25 kilogram or 25 litre;
8. In the said rules, in rule 18,- (i) after sub-rule (1), the following sub-rule shall be inserted, namely:- “(1A) The wholesale dealer shall be allowed to sell the pre-packaged commodities directly to the industrial and institutional consumers.”.
(i) after sub-rule (2), the following sub-rule shall be inserted, namely:-
"(2A) Unless otherwise specifically provided under any other law, no manufacturer or packer or importer shall declare different maximum retail prices on an identical pre-packaged commodity by adopting restrictive trade practices or unfair trade practices as defined under clause (c) of sub-section (1) of section 2 of the Consumer Protection Act, 1986 (68 of 1986). more

25 KGS or 25 lts must be used in an industrial unit and not put up for sale at higher retail price. The single bottle must be sold at one price only. The charges in malls at higher MRP is illegal and must be challenged. Water is the same and only brand names are different . Govt is creating problems by framing weak laws which are unfriendly to consumers. more

It is confusing. How a bunch of 25 bottles put together in a box or carton could be treated as a packet or package to take the advantage of the loopholes of the said law. Moreover, the flexibility for dual pricing has been provided in the law to benefit the purchasers of materials weighing in excess of 25 KG or 25 lts with lower MRPs but it is being grossly misused by the greedy trading community to dupe the common man. Further, how any law and government can allow the manufacturers to differently price any commodity of same quality & quantity, that too, by 8 to 10 hundred times of their actual price? Its a tragedy for us that our government leaves many loopholes while framing a law to benefit the powerful dishonest people whose primary profession is to suppress and loot the common men, in which the people in our government(s) are also stake holders. more

Whole sale price could be lower than the retail pack, that does not allow dual pricing for retail pack. more

IF bulk buying has a MRP it should be lower than the individual single bottle ..and where is the question of over charging wrto the single bottle.?.There should be one MRP ideally and in any case bulk buying would be at a lower price.. more
