Cease of Residential Project (81.77 Acres) of Era

I am a sufferer of a real estate giant ‘s non-compliance.
I dared to invest my hard earnings by booking a plot in Era Landmarks Ltd at Palwal, Haryana .

The entire payments was made by me as per the company’s installment schedule.

The Developer has failed to hand over the plot within said assurance period of time.

The Developer never informed me that he has mortgaged the land.

Now the bank (IFCI ) has ceased the land of borrower (Era landmarks Ltd.) under “Securitization & reconstruction of financial assets& enforcement of security entrust act 2002 section 13/2” with respect to non repaying its amount.

Now i am in trouble.My hard earned money has been blocked last six years.

kindly suggest what should i do???

Hetraji, sorry to hear about your grievances. Let me be frank with you all. After freedom of our country, no government is honest with citizens of India till date. Number of times government changed but no one protected us from such corruption. It is shameful at BJP also that they have not yet made any strict law against builder lobby. If they want they can. Let us consider your case. What BJP government can do in this regard to protect is as follows :P 1) Ignore pressurising tactics of builder lobby. 2) If builder blame other non registered builder who are cheating customers, should support customer to get their property by several ways. i) Take the charge of such corrupt builders legally within a week time. ii)New Builder can relaunch new plan or extend their construction work at the same site. iii) Cheater builder should not be entertained in court or illegally. 3) State government should arrest the corrupt builder and his partners, family members etc immediately against complaint. 4) There should be a source from Government to attend complaints of customers. 5) Government should acquire property of corrupt builder within a week time against complaints from customers. 6) At any cost no corrupt builders should be spared by government. , because Court and consumer forum takes its own time which is not affordable to the customer. 7) Government and other opposition paries should pass law against corrupt builder without any delay. Let us hope by 2016 we will be considered as human being by BJP government. more

There are several remedies at your disposal. Write from Police Complaint - like EOW if you are having few more victims like you. In Mumbai there are several cases including the star celebrities, wherein EOW intervened and the developer has to give undertaking of time bound program. Over and above there are Consumer Protection as well as civil remedies wherein you can have your money return/possession/ compensation/ damages etc. more

To go to consumer court for justice against to the developer. Always prefer for a bank loan to be secured even if you are capable for purchasing on your own to overcome the above crisis in future. more
