I was working in a company and left them in september 2015 after working for 6 years as the company has run into a financial problem. The issue is that they have not yet deposited income tax for the entire year 2015-2016 and form 26AS is not there. As a result I could not submit my IT declaration for 2015-16 as my accountant said that in absence of form 26AS nothing can be done. As I will be getting refund from IT I could so far not fill the IT declaration and wondering what should I do. Recently heard from the company that taxmen are after them and the company will submit it in a month's time. Will that be not too late.
PS- I get IT refund every year as I work as consultant and the company professional fee @ 10%.

Now no organization can issue Form-16. They have to down load the Form 16 from Income-Tax web site and issue. This is only possible , if the organization has deposited the TDS amount and TDS return is filed. more  
FIRST GET FORM 16 TO CLAIM REFUND. DON'T THINK ABOUT OTHER EXPENSEES.GET SOME THING IS BETTER THAN NOTHING BY REFUND. more  
In that case they would be a serious defaulter .. also u can not claim refund as they have not deposited TDS amount.. The return will show u amount payable based on amount of income .. try out and let me know more  
Dear Mr Ashim Ganguly, it is an old organisation with existing PAN and they have been issuing TDS certificate since more than 20 years only recently they are in financial trouble and have so far avoided paying IT for 2015-16 more
