Service Tax Registration

Hello, We are a new start-up. Wanted to get valuable advice whether we need to register for service tax considering - None of the services we offer are provided to anyone in India. All our customers are foreign companies. more

Mr Santhosh Hegde as you have mentioned that you had discontinued your professional services as consulting engineer since December 2015 and even changed your residence from Angul (Odisha) to Udupi (Karnataka) and now you want to change your office address online and seek help from this circle to do this job. Here I would like to clear you that the excise and service tax registrations are granted for a premise not to individual person. Hence in your case if you want to continue your existing Service Tax registration then you have to declare your office address at Angul (Odisha) as your official address fro providing services of consulting engineer otherwise you have to surrender your present ST registration as change of place of business or discontinue of business. Now if you want to take yourself registered under Service Tax for future assignments then you have to apply a fresh registration before the concerned service tax authority declaring your present office or residence address from where you want to provide services or to get yourself registered. If you decide to retain your existing ST registration at Angul, in that case you have to file ST-3 regularly for NIL turnover at Angul otherwise you may be penalised for not submitting ST-3. Hi every body here is advising Mr Walia deeming him a prospective client but it is strange that one of our respected member Mr Santhosh Hegde has asked some advice but no body is helping him even Mr Krishna Kumar from whom specifically Mr Hegde has asked is not responding here. I think the reason behind this may be that as Mr Hegde has discontinued his services as consulting engineer so he is not a prospective potential client now. Being a professional this type of thinking is extremely wrong and against the professional etiquette. more  
Dear Mr. Akhil, First of all best wishes for your venture. Let's guide you for requirement of getting registration with Service Tax Authority. It is mandatory if you are providing any chargeable service and turnover in a financial year exceeds Rs. 10 lakhs. As per department instructions; one needs to get registration as & when turnover exceeds 9 Lakhs. If you are not fulfilling these criteria then no question of getting the same. Mr Walia as per service tax act if your gross turnover of services crosses 10 lacs in any financial year then you have to apply for service tax registration at the time when you cross 9 lacs during the year. As you are saying that all of your services will be provided out of India as all your customers are out side India it means your services falls under the category export of services and these services are exempted services. On such export services there is no liability of payment of service tax but you have to file service tax returns to claim exemption of export of services. If you think that you will cross 10 lacs of services from the first year of your business then apply for service tax registration without wait. The procedure of service tax registration is online and if you had filled all the columns of ST - 1 correctly then you will be allotted service tax registration and ST - 2 will be issued by the service tax department. more
