Redevelopment by Caretaker Managing Committee?
Can a Caretaker Managing Committee ( term of 5 years over ) undertake any activity related with Redevelopment as Agenda in Managing Committee meetings, General Body Meetings, make payments to Architects / PMC / Advocates & Sign MOU with any developer ? If repmy is no, then holding elections as per rules on or before 31.03.2022 and all abive activities be undertaken thereafter by new Committee, right ? more
Redevelopment of housing societies in Maharashtra is governed by separate regulations. Separate committee must be formed in the general meeting to deal with redevelopment. Of course final approval lies with AGM or EGM. Ideally AGM or EGM gives approval to the special committee formed for this purpose. more
In my view whether and what strength Redevp Committee should comprise of are only suggestions. There is no absolute clarity that MC can't carry on such work as there is no concept of Caretaker MC. It is presumed that any payments exceeding limits are already approved by GBM. In such situations it is advisable that for periodic action MC should convene SGM (may be at short notice) and take powers and proceed or get the appointment/expenses etc approved thereat to avoid any such challange more
There should be a Committee Consisting of minimum 5 Members dedicated for Redevelopment activities. These members should not be a part of Management Committee for Day to Day Routine Works of Society. Redevelopment is ANYWAY NOT A ROUTINE ACTIVITY. The Terms and Reference of this Redevelopment Committee is as finalized by General Body. The idea is to Complete this Tough Works in the Most dedicated way by this Dedicated Committee which will have financial powers which Does Not exceed the terms approved by General Body. Any Mg. Comm is a Care taker of society. The term may be extended by Govt notification or even by General body. As long as all precdure is followed as per law, without any self interest and with the prime benefit of all society members only, it does not matter .
