No Objection Certificate requirement for First floor owners. Totally wrong
The requirement of no objection certificate for the first floor owners from the ground floor owners for building additional floors is totally wrong. The government should really do something in this regard.
It is the government who should take the authority to check if the additional floor is safe/legal and not the ground floor owners.
This is causing nothing but corruption. more

No but then, if the FF owner has explicitly bought roof rights and is ready for a thorough inspection to make sure that the additional construction is harmless and the authority is ready to give a clean chit as per the safety is concerned, in that case why does it have to be the GF owners who have all the rights to say no to construction for no reason at all. The only reason they hold against is why should the FF owner be benefited?? Is this not illegal/immoral/unethical. more

totally agreed. NOC should have issued by authorities after getting NOC from GF owner. Here in Delhi most of the flat owners thought that they are CIVIL ENGINEER & they used to do even internal changes without knowing whether its a load bearing structure or framed structure. How can be it ensured that GF or any other floor owners will not feel inconvenience due to construction. What are the terms and conditions of owning the roof, who has got the right to own. Govt. can not approve anything in anticipation that no one else would feel uncomfortable due to construction activities or no one else has any claim on the proposed property. It could also be possible that the GF owner has gone out of India and the FF owner has constructed on the roof the title of which belongs to GF. more

Govt . Should have eminent structural engineers to clear such proposals who can review the strength of foundation and building condition to take care additional load . . There should not be any need of NOC from Gr floor owner unless they they are not put to inconvenience during such additional constructions in the building . more
