What if we construct something illegal in our resort and we get notice from government to remove it as it's illegal..then others members of resort file a case on us for removing...which is still going on not ending...when we are following rules and why the judge accepts this type of cases for removing illegal construction..which we made it to legal...what to do?? more

When the Peoples are knowing that it is illegal then why they are doing it ? It is the way to Prolong the illegal matter if you have money. It is the Correct example. The Local authority should be demolish the structure & recover the cost of demolishing by charging 3-5 times + Jail for 60-90 days. It is good practice to stop these matters. more

Yes I'm also surprised why they filed case when it was illegal...and we demolished it as it was illegal..very strange...if we do it for good and legal still people file case and it's on since 2003... more

Does it have no limits and by giving it this unlimited power, are we allowing it to move towards dictatorship? Excessive freedom is never beneficial and it should be controlled, only then will justice be delivered, otherwise only judgment will be delivered. more

Indian judiciary takes too long, in some cases even 10 to 20 years & even more than than to resolve cases related to land. I simply fail to understand where is the fault, is it in the penal codes, in the revised penal codes or in the system itself ? I feel, rampart misuse of providing a next date is the prime reason for delayed justice. There should be stricter guidelines to judiciously provide a next date (only in cases of emergency & for justifiable and valid reasons with fixation of suitable accountability towards the same) for cases related to land & for that matter , for all cases, which will definitely speed up the care resolution duration. more

Here’s what you should consider: 1. Gather All Proof Copy of the government notice asking for removal. Documents showing that the construction was unauthorized. Proof that you removed it only because you were required to, not on your own whim. Any meeting minutes or communication with other members about the issue. 2. Legal Defense in Court Your lawyer should clearly argue that: You acted under compulsion of law. You were preventing future penalties or legal trouble for the whole resort. The construction was never regularized (if that’s the case). 3. Counterclaim or Dismissal Request If the case is baseless, your lawyer can apply to dismiss it early. Or you can file a counterclaim for harassment or loss caused by unnecessary litigation. more
