FIR if you take stray puppies out of society

I find this a bit ridiculous that the savious of animals can file an FIR against society management for taking out stray puppies from the complex. What if these puppies bit small kids in the society. Who is responsible. Then there should be FIR against who? There has to be better solution than this then filing FIRs against each other. Shouldn't the Noida administration set up some rules around stray animals.

The People for Animals (PFA) has lodged an FIR against the builder, secretary and security agency of a Noida-based society after they separated weeks-old puppies from their mothers and threw them out of the premises.

The FIR was registered at Noida Sector 49 police station against the builder of Prateek Wisteria in Sector 77, the Apartment Owners Association (AOA) along with the secretary and security agency.

According to a PFA member, two female dogs gave birth to 12 puppies in the Prateek Wisteria last week. On November 19, they were thrown out of the society. When some residents informed PFA member Kaveri Rana Bharadwaj, she lodged a police complaint.

Police confirmed that an FIR has been lodged under Section 11 of the Prevention of Cruelty to Animal Act (PCA) 1960, and sections 428 (mandates a punishment of two years' imprisonment or fine, or both, for killing or maiming an animal of value of Rs 10 or more) and 429 (mandates a punishment of up to five years' imprisonment or fine, or both, for killing or maiming an animal of value of Rs 50 or more) of the Indian Penal Code.

"When residents informed me about the step taken by the AOA, I was shocked. So, I immediately spoke to the AOA secretary. She told me she was thinking about taking some steps as the puppies were a nuisance. Later, a society member informed me that the puppies have already been thrown out," Bharadwaj said.

Then Bharadwaj and resident Pragati Khanna visited the society only to find that nine of the 12 puppies were living on a vacant plot near the society while three had gone missing.

She added that the security guard at the building's gate admitted to the incident. Now, a search has been launched for the missing ones.

In response, the secretary of the society also lodged an FIR against the PFA and a resident at the same police station, under IPC Sections 289 (negligent conduct with respect to animals) and 506 (punishment for criminal intimidation).

"Last Sunday, the AOA called a meeting that was attended by all residents. The decision was taken unanimously as everyone agreed that the puppies were creating a lot of nuisance. We took this decision after a general agreement," said society secretary Nisha Rai.

She also said that as many as eight people have been bitten by dogs in a week, and their medical reports have been submitted to the police station. Investigating officer Padam Singh said: " Initial investigation suggests the dogs had become a menace. We can say more only after a complete probe." more  

You need to update your knowledge on animal behaviour in that case no animal would bite unnecessarily without any reason unless provoked one, secondly those little puppies are going to bite really are you serious when you say this poor little puppies are themselves scared of humans I'm in favour of lodging an FIR if anybody does that, also those puppies have no interest in staying in complex forever they themselves would leave society after they open their eyes & are on their own It's humans you should be scared of for your kids not new born puppies Its ridiculous that you are even writing this Kindly show some compassion towards other living beings, humans are not the only the ones living on this planet You don't own the planet, Make kids learn how to be compassionate since childhood no dog will bite just for fun unless suffering from rabies so enlighten yourself through google knowledge , human are not the only ones made for this planet other living creatures have equal rights to live on the street even the Supreme court says so more  
A few points to ponder upon: 1. Why did Society management or Security on behalf of the management failed in preventing entry of stray dogs in the Society? Had they taken preventive steps, this situation should not have arisen. 2. Don't residents of a Society have any right to protect themselves, at least on the property they own, they have paid for? Though it's because of their negligence only that this situation had arisen. 3. What PFA is doing when numerous chickens and other animals are slaughtered on daily basis to enrich their diet and health? 4. What PFA is doing when numerous animals are slaughtered in the name of Sacrifice? 5. In this particular case, AOA could have taken help of municipal authorities, though it's really a tough job and lot of patient follow up is required. more  
I totally support you Bhavana. It is very sad that that people are finding it easy to file FIR, but no one is caring about these puppies. Such people should do something for keeping them in proper place then feed them regularly, instead of leaving them in open to bite the residents or guests and specially the children. I have seen many residents, who get puppies for their home and keep them at their home, but take them out in front of other's home for a shit. Every morning / evening you can find many people taking out their puppies on road for shit in the name of 'for a walk'. - CA Ashok Malhotra more
