Encroachments in Noida - Inputs on Issues

Noida Residents:

We have seen multiple posts/comments from you on encroachment of public space. With this post, we would like to seek your inputs on various types of encroachments in Noida. To solve this problem in a systematic and sustainable way, it is important we go beyond a few individual grievances and review it.

Once we understand all the issues, we can then have a separate discussion on solutions.

Mr Mohinder Singh, -You have hit the nail on its head---I strongly believe that all this email-business,showing concern for the residents, is sheer window-dressing ; this is just to keep the residents busy writing emails day-in and day-out and creating an illusion that the Noida Authority just might be awakening from the deep slumber it has fallen into---its the action which counts,really---and there is no sign of it at the moment . Let the Authority give a time-frame in which action would be taken---or would any action be taken,is the million-dollar question. more  
Sumit, I strongly believe that if the office of the DM simply makes an announcement to the effect, over a loud-speaker only,in all the sectors,it should have the desired effect ; it should give residents 15 days to remove the illegal encroachments pending which the Authority shall remove these encroachments AT THE EXPENSE of the concerned RESIDENTS . Believe you me,this shall set the ball rolling. At places,garage has been converted into a drawing room and 3-4 cars are being parked outside,to the discomfort of the neighbhours ; in other cases,land right up to the road occupied by these ground floor residents---some have made lawns,others have made a room,still others have made a garage on the govt land---its an absolute rip-off. But do you think Noida Authority serious on this encroachment issue----me-thinks no.Time shall tell,friend. more

Dear Sir As per my understanding the below are the types of encroachments made by residents in societies and particularly the ground floor residents. a) Sheds to cover their ground floor area -> Ground floor residents put sheds to cover their premises but it impacts neighbours on higher floors. Ground floor residents keep enjoying the greeneries and views along with sheds but it creates issues for the residents on higher floors. They are not able to see greeneries and views because of this. Moreover, these sheds used to remain dirty and full of dirt and rain water. This becomes a breeding ground for mosquitoes too leading to dangerous fevers (like dengue, chikunginiya etc) and impacts swatch bharat abhiyan. b) Modifying the common area structures set by the builder -> Builders use to surround the ground floor area with iron railings. These are meant for security purposes. Many residents on ground floor modify this security structure also for their own benefits. This is comfortable for the ground floor residents but breaches security for the society tower as a whole. Many times it is seen that they put an almirah on the common area wall around their ground floor flat, creates doors within this security barrier for their entry and exit but they don't realize that it breaches security for whole of the tower. This again is a huge security risk. c) Business purposes -> Many residents build these encroachments for business purposes as well. They break the builder agreement clauses and start using these sheds for business or commercial purposes. They cover these sheds and make an extra room where they can do their own business. As per my view the solution to solve these issues should be approached like this: a) Corrective actions 1. Priority 1 - target societies that are less than 5 years old - District Magistrate along with Noida authority need to order the builders or RWA to provide them the report of all their ground floor residents who have done encroachments. Builders in turn need to issue a notice to such residents copying the same notice to Noida authority and your deemed office. If the encroachments are not removed within 15 days, Noida authority should come with their team and remove the encroachments by charging the ground floor resident. If you want to see as an example, you can target new societies in areas of Sector 119, 120 and 121 where builders like Gaur, Eldeco have come up with the societies. You can even verify such illegal encroachments on ground floor flats from the main road in some of these societies. But you also need to ensure that such cases are handled within time, no officer should bypass such cases with any kind of lure from residents if any. 2. Priority 2 - target other societies that are more than 5 years old and based on complaints from the residents on higher floors. You need to check from builders or RWA of the society to report such cases to you and Noida authority. b) Preventive actions for upcoming societies - For new societies builders need to ensure that such things don't happen. Your deemed office should remove these sheds and track such complaints. - You need to create an email id where residents can complain of such matters to the Noida authority engineer assigned for their society. This complaint should also reach your deemend office team as well. Both your office and Noida authority need to work in tandem and sync on the common status. - Such issues can be made public on your portal as soon as you receive a complaint of such encroachments from either builder or resident. Action items and responsibilities should be assigned and updated within stipulate deadlines. more
