Court cases of "will" lying pending since years

Dear Sir,

Please note there should be a stipulated time frame such as 6 months or 1 year maximum for giving judgement on civil and criminal cases as judiciary is not giving judgement on time and cases are lying pending since several years say 30 years in courts. People are being asked to make out of court settlement after 30 years and most of them die while fighting fake cases. Judiciary is being influenced by paying hefty amount of bribe through staff and lawyers which should be also taken care of. Judiciary is giving another date in civil cases without hearing it properly say after 5 minutes which is after 6 months and in case another party or lawyer don't turn up then another date after 6 months. So these cases are lying pending since several years and judges are trying to keep their hands strong by working upon all kind of angles as they know that their judgement will be challenged in higher court. There is British law prevalent in India as Britishers ruled over us for 200 years but govt. don't know that they themselves are settling cases in 1 or another hearing on the basis of material evidence and don't keep people waiting for years. Judges don't hear more then 4 cases in one day and give judgement in one or 2 hearings. Please pass a law in parliament for speedy hearing and giving judgement in stipulated time frame. My case which is being files by my younger brother on fake grounds is lying pending since last 4.5 years in Rohini court and we are getting same treatment which I have written earlier which is probate of last "will".

Fully agree with the views.The courts are taking every institutions to task but not setting their own house in order for the inordinate delay in providing justice. more

I am totally agree with views of yours . Judiciary must be bound to settle cases within stipulated timeframe so that justice would be given on time to people who are fighting from long. more  
All said and done, every body knows that justice delayed is justice denied. Why not Modi Govt. is coming forward with judicial reforms. It is the duty of legislature to draft such a legislation which ensures speedy administration of justice. Something positive and concrete has to be done by someone. If Govt is sleeping, let the litigants join hands and force the Govt to initiate effective steps to ensure speedy justice. Me myself is a victim of the judicial system. My elder brother has unauthrizedly occupied my house for the last 12 years and also filed a civil suit against me to seek legal protection for his unauthorized stay in my house. In the civil suit, even Issues have not been fixed in the last 11 years. Most of the times, the lawyers go on strike on frivolous grounds. Adjournments are given without any cause. Maximum period to deliver judgement should be fixed and it should not be more than one year. The Govt should form a Judicial Reforms Commission to recommend improvements in judicial system and its recommendations should be implemented without delay. more  
Sometimes it is a joint venture by the advocates of both sides and the judge. It is true that there are crores of pending cases. while certain cases for specific reason will have to be kept pending unnecessary extension of date has become 'standard' practice. When hearing date is extended it must be intimated to both the parties specifying the reason of extension, means it should not be at their will! more  
Judges have been given unlimited powers. No one is to monitor what are they doing. They keep on giving dates after dates. Some times they damage developmental projects. (example Yamuna Eaxpressway Authority 21000 plots heading for unlimited delay). The condition of the courts is alarming. A poor man can not expect justice. The lawyers demand huge fees and can take up any case of crime, corruption or even of terrorists. If justice is to be bought at a price, what kind of justice is it? Courts keep on calling complainants and opposite parties. By giving next date they waste the time of the people. If personal appearance is limited to the final argument and arguments are not postponed again and again, the cases can be disposed early. Government's role is not proper. On one hand there is lot of unemployment on the other hand courts have too much of pending cases. Why the courts can not be expanded. Why courts can not work in at least two shifts. Why courts can not be efficient. If courts work in this manner and they can not improve their efficiency the judges should not be called "Honorable" more
