Allow the CM to function

All the suggestions here will remain unfulfilled, if Arvind Kejriwal and his cabinet are not allowed to run the government in Delhi.

Have we ever had a ridiculous situation of the constabulary restricting the movements of a chief minister. Can the Home Minister explain to the citizens of Delhi, under which constitutional provision a duly appointed constitutional functionary's, (the CM), movements are being restricted. Also is the CP superior to the government of Delhi, in which case we need not have had the farce of an election.

Tomorrow they can stop the movement of the CJI, or the CAG or anyone else, if someone finds their movement inconvenient.

Regarding the episode of Somnath Bharti. There is a lot of hype because of little or no understanding of the law. Please read Section 43 of the CrPC. It will clear the air, as to how the media and various spokesmen are trying to mislead citizens. more

We have stringent laws but with absolute situational discretion vested with the police officers and their absolute immunity to accountability u/s 197, please have a look on CrPC 46 subsection (3) it gives right even to kill a person who is merely accused and the crime may entail life imprisonment or death sentence, what a bloody law of lawlessness, also see CrPC 129,144, we need to get them repealed immediately and simultaneously demand Jury trials and joint inquiries against police excesses, inquiry committee's should have members of civil society and judiciary too. Anyway please have a look on this too Police Reforms From Peoples’ Perspective-Public is Police.(Power to People) वर्तमान टकराव है जनता की प्रजातान्त्रिक अपेक्षाओं का साम्राज्यवादी ताकतों के साथ -भारत के सभी राज्यों में पुलिस व्यवस्था आज भी अंग्रेजों द्वारा बनाये गए अर्ध फौजी ढाँचे, अर्ध फौजी ट्रेनिंग एवं फौजी अनुसाशन, तथा आम आदमी को भयभीत कर वसूली करने की नीतियों पर आधारित है /जिसका परिणाम है जनता की प्रजातांत्रिक अपेक्षाओं का वर्तमान पुलिस व्यव्य्स्था की कार्यशैली के साथ सीधे टकराव तथा इससे उत्प्प्न मुकदमेबाजी एवं हिंसा तथा पुलिस के प्रति जनता का अविश्वाश/बुनियादी ढांचे की त्रुटियों के परिणामों का शिकार आम आदमी ही नहीं अपितु अपने विवेक से न्याय करने एवं सत्य के राह पर चलने वाला प्रतेक पुलिस अधिकारी इस ढांचागत खामियों का शिकार है / वर्तमान पुलिस ढाँचे में 86-90 % कांस्टेबुलरी तथा 12-13% सब इंस्पेक्टर एवं इंस्पेक्टर हैं जो की ३०-३५ वर्ष की सेवा और अनुभव के बावजूद एक अथवा दो पद प्राप्त कर रिटायर हो जाते हैं/ वर्तमान पुलिस ढांचे की 99.87% संख्या उपरोक्त वर्ग की है/ 0.13% IPS अधिकारी जो सम्पूर्ण महकमे की बागडोर सँभालते हैं तथा राजनेताओं के समक्ष केवल एक बिचोलिये एवं मीडिया के समक्ष केवल एक जन सम्पर्क अधिकारी की भुमका निभाते रहते हैं इनकी सेरेमोनियल कार्यशैली तथा ट्रेनिंग इन्हें वास्तविकता से कोसों दूर रखती है जिसका खामियाजा भुगतती है आम जनता / एक ओर अंग्रेजी कानून व्यवसथा एवं कार्यप्रणाली उस निरंकुश IPS श्रेणी को जन्म देती है जो प्रसाशनिक एवं अनुसाशनात्म्क शक्तियों से लेस हो, सम्पूर्ण पुलिस महकमे के कुकृत्यों को संरक्षण दे कर लोकतंत्र के लिए खतरा उत्पन्न करती है वहीँ इस निरंकुश श्रेणी की निष्क्रियता तथा इसके संगठित भ्रस्टाचार के लिए उसे जिम्मेदार ठहराने का कोई मापदंड नहीं है/ रोज़मर्रा की पुलिस किरियाकलापों में इस निष्क्रिय श्रेणी का अनुभव विहीन रोल बिना जवाबदेही का है जिसका खामियाजा भुगतते हैं उसके निचे वाले अग्रिम पंक्ति पुलिस अधिकारी तथा पुलिस की शिकार जनता / सर्वोच्च न्यायालय के दखल से आरम्भ किये गए पुलिस सुधार किसी भी रूप से 99.87% अग्रिम पंक्ति पुलिस वर्ग की कार्यक्षमता, कार्यकुशलता को बढ़ावा नहीं देते तथा ना ही यह बढ़ावा देते हैं IPS श्रेणी की जवाबदेही को और परिणाम है सुधारों के लागू होने के बावजूद पुलिस विभाग जहां के तहां खड़े हैं / देश में प्रजातंत्र की सुरक्षा के लिए सर्वप्रथम ज़रूरी है प्रजातान्त्रिक अपेक्षाओं के मुताबिक पुलिस के पुन: प्रसिक्षण एवं कार्य कौशल के आधार पर सम्पूर्ण पुलिस विभाग के निम्न वर्गों में वर्गीकरण की पेट्रोल आफिसर , इन्वेस्टीगेशन आफिसर, स्पेसिलिस्ट्स(फोरेंसिक/टेक्निकल आदि) तथा पॉलिसी मेकर्स में वर्गीकरण की / कांस्टेबल से लेकर कमिशनर/डीजीपी तक की योग्यता का परिक्षण कर इन्हें उक्त वर्गों में पुनर्गठित कर इनका वेतन इनकी योग्यता तथा निभाए जाने वाली जवाब्देहियुक्त जिमेवारी के मुताबिक निर्धारित किया जाये / जिससे की नागरिकों को प्रजातान्त्रिक मूल्यों पर खरा उतरने वाली एवं दक्षता पर आधरित पुलिस सेवा प्राप्त हो सके/ पहला कदम है साझा बैठक द्वारा लोकल सामुदायिक नेताओं एवं अंग्रिम पंक्ति पुलिस विभाग के इस वर्ग के बिच खुले संवाद की, जिससे की अपराध/संगठित भ्रस्टाचार पीड़ित जनता की प्राथमिकताओं के मुताबिक पुलिस क्रियाकलापों को व्यवस्थित किया जा सके/ साथ ही आवश्यकता है चुने हुए राजनितिक प्रतिनिधियों को पुलिस के नीतिगत मुद्दों पर समयबद्ध सीमा में निर्णय लागू करने की जिससे पुलिस महकमे का तुरंत असेन्यीकरण, विकेंद्रीकरण तथा /Police Reforms from Peoples’ Perspective-Public is Police(PRPP-PP) शुरुआत है इस दूरगामी मुहीम की जो की न केवल आम जनता की तत्कालीन सुरक्षा जरूरतों को जानने एवं पूरा करने की प्रकिरिया को आरंभ करेगी अपितु नीतिनिर्धारकों एवं जनता एवं अग्रिम पंक्ति पुलिस अधिकारीयों के बिच सीधे संवाद को आरंभ करेगी जिससे की पुलिस व्यवस्था में आमूलचूल ढांचागत बदलाव लाये जा सकें तथा पुलिस को प्रजातांत्रिक बनाया जा सके more  
For Sonik Porwal: A Cognizable Offence includes murders, rape, kidnapping, abductions, robberies, drug related crimes etc. In every case of a Cognizable Offence, the police are required to register it in the First Information Register (F. I. R.) and investigate the offence. In its investigation, the Police officer may in accordance with the first schedule or under any other law for time being in forced arrest without warrant and also start investigation without any orders or directions from the Magistrate. You will notice that in such cases, the police can act without a warrant. This is the point that Somnath Bharti was conveying to the police officers on the spot in Khirki village. more  
The text of Section 43 is attached with my post. However here is the extract. Section 43 in The Code Of Criminal Procedure, 1973 43. Arrest by private person and procedure on such arrest. (1) Any private person may arrest or cause to be arrested any person who in his presence commits a non-bailable and cognizable offence, or any proclaimed offender, and, without unnecessary delay, shall make over or cause to be made over any person so arrested to a police officer, or, in the absence of a police officer, take such person or cause him to be taken in custody to the nearest police station. (2) If there is reason to believe that such person comes under the provisions of section 41, a police officer shall re-arrest him. (3) If there is reason to believe that he has committed a non-cognizable offence, and he refuses on the demand of a police officer to give his name and residence, or gives a name or residence which such officer has reason to believe to be false, he shall be dealt with under the provisions of section 42; but if there is no sufficient reason to believe that he has committed any offence, he shall be at once released. Selling of drugs is a cognizable offence. more
