Agriculture land's converted to plots by real estate mafios

I am belongs to small village from karaikal, pudhucherry UT. In our area, day by day interest in doing agriculture was reducing by the people due to no good value for the grains, poor water management and not aware of agriculture advancement. Now another problem started by real estate people, these peoples were bought land from people are un interested in agriculture. After that they were making fences around the area. We can not move inside our land, because our lands are unitly packed. There is no separate road for our each persons's land, so we should cross others land by this only we can reach our personal field. But this way was blocked by real estate people and forcing us to sell the land to them.If this way continues we can not see any paddy field in my village. In my last vacation I found this issue and I fought with them but they having good support from local politician's. I received some strong reaction from them but I am ready to face this issue. In the same time I want take this issue to another level.... So please guide me to how i can promote this issue to court as well as media....... more

Dear friend, hello.I have gone through your problem you are facing right now.as per law is concern, every one has right of passage to reach his land /property. This right is called easementary  right.you will  know about this right in Easement Act. This right is based on the principle of equity and good conscience. No one can stop you to avail your right. Second thing is that some group of people are conspiring against you for the purpose of grabbing your property. First of all make a written complaint against those people before the proper authority.Second thing you can do is that make an inquiry through RTI, whether these people has properly taken permission for the purpose of constructing building from the authority of Gov.  on the agriculture land as per law. Collect all informations regarding the same and If don't get any such kind of relief on your complaint, go to the authority of the court on the document available to you. You may go directly to the High court under the writ jurisdiction under article 226/227 of the constitution by way of writ of Mandamus.                                                                                                  Thanking you.                                                      Pancham Kumar Jha                                                      Advocate, New Delhi From: Hari Haran Sent: Sun, 11 May 2014 14:27:43 To: pkjhaadv@rediffmail.com Subject: New post "Agriculture land's conver..." in [Modi for PM] more
Mr. Kochhar is right in his assessment. However, if Industrialisation is taking place, let is be done at places where there is no agricultural land. I have seen big industries are created in deserts! and are successfully working under glaring sun with temperatures hovering above 45-48 degrees! But such areas must have all infrastructure including good roads, water, power airport and seaport etc. Secondly when we take into consideration of ROI, we will take into consideration all aspects to ensure balance is horizontal. Thirdly, our agriculture is in villages and not in bid cities like Delhi Mumbai. If our irrigation system works with connected rivers, we can surely produce surplus food for all our ppl and export it to other countries. We have plenty of unused land and it can be used effectively with power and water available. more
I would not say that only land mafia is at work and that their is only a political angle to it, in and around Delhi a govt authority(DDA) is purchasing fertile agricultural land to be used later as residential societies , they are waiting for population growth and demand for new homes from public, they have done this to also dissuade land mafia from grabbing this land from farmers and selling land to public at large profits, in the meantime the same land sold to DDA is being used by the same farmers to cultivate their land. But many major concern to ur point is if we only look at ROI against industrialization , farming will never ever win, and GOd forbid if a situation arises that INDIA has to feed its population despite industrialization ALL THE PROFITS may go down in drain just to feed a small Indian population leave alone entire population of 1.3 billion. AGRICULTURE IS ONE OF THE MOST IMPORTANT aspect of civilization since time millenium. more
It is better not to jump to a conclusion that land mafia is at work. One must analyse the whole issue, contact concern departments for clarifications, information and after through analysis must come to a conclusion. Check the existing laws for dealing in such lands etc. If the salt land is used for salt production, one must see the ROI and if possibility of better utilisation is studied while Industrialisation decided. Let us tackle all this professionally and not from political angle. I feel distinction must be made between politics and management and all must be views from that angle before coming to any conclusion. more
