Some people are raising questions on Arvind himself for challenging the rigidity of our judicial systems.

These people need to introspect and decide if they want to live with the existing system or at least morally support a person who's challenging it.

कुछ लोग अरविन्द के बेल ना लेने के फैसले पर सवाल उठा रहे हैं. उनको तरह तरह की उल्हनाएं दे रहे हैं!

उन लोगों से कुछ सवाल हैं:

१. जब पुलिस वाला FIR नही लिखता तो जनता कहती है के कानून गलत है और कानून के रखवाले भी |
२. जब किसी आरोपी को सालों साल जेल नही होती तो यही जनता कहती है के न्याय प्रणाली कमज़ोर है जो न्याय नही देती |
३. अब जब की श्री नितिन गडकरी जी द्वारा एक केस दो लोगो के खिलाफ लगाया गया, एक अरविन्द और दूसरे दिग्विजय सिंह पर, तो अरविन्द को पेशी पर बुलाया और ज़मानत राशि देने को कहा गया और न ज़मा करने पर जेल, तो न्याय प्रणाली एक दम से अच्छी कैसे हो गयी?

सब जानते है की न्यायपालिका इस केस को कितना लम्बा खींच सकती है और ये भी जानते हैं की अरविन्द चाहे तो २ मिनट में बेल बांड भरकर बाहर आ भी सकते है. लेकिन लोगो की सोच को क्या हुआ?

आज भी देश में हजारों लोग सिर्फ़ इसलिए सालों से जेल में सड़ रहे हैं क्यूंकि उनके पास बेल भरने के पैसे नहीं हैं. अरविन्द ने न्यायपालिका की जड़ता का विरोध करने जैसा मज़बूत कदम उठाया है. फिर भी उनको ही दोषी बताया जा रहा है.

आपमें से जिन्होंने पुलिस और न्यायालय के चक्कर काटे हैं वो समझ सकते हैं की अरविन्द किस चीज़ के विरुद्ध खड़ा हुआ है. आज तक कितने लोगों ने ऐसी हिम्मत दिखाई है?

जब किसी ने अब ये हिम्मत दिखाई है तो कम से कम हम उसका समर्थन करके इस व्यवस्था की जड़ता को चुनौती देने में कम से कम सैद्धांतिक रूप से उसका साथ तो दे ही सकते हैं. more

There are some stories about how poor people are suffering for decades because of this gap in the law. Anyway, let us see what the High Court has to say. more  
Kewal ji; I do agree that Yogendra Yadav ji explained in that way. To my understanding, bail bond is to kind of ensure that the person obeys the order for appearance in the court when required. This is where judge can use discretion which in turn depends upon the person's credentials and perhaps paying ability. In this case, AK's credentials as we all know, are of the highest order and so also of YY. In a way Judge did not accept AK's credentials sound enough and YY accepted to sign bail bond for the sake of his personal convenience without testing the Judge's judiciousness. So, while one accepted to challenge, the other did not. Dear M/S Puneet and Sudarshan Goyal, I do not know who is supposed to have replied to you. But I can share what I gathered from TV. On two occasions, I heard Yogesh Yadav explain this in detail. You see, the two cases are different. In AK's case, no crime had been committed by him. He had been asked to appear before the court and then get a bail for appearing on the next date. He refused. In YY's case, an offence is supposed to have been committed because they violated Section 144. So, he was ARRESTED. Nothing of that sort happened with Arvind. (It is a different matter that AAP will prove in the next hearing of YY that Section 144 was not imposed as per the rules). Are you aware that lakhs of innocent people all over the country are rotting in jails, because they are too poor to pay the personal surety a la Arvind ? That is the status of justice in our country. महोदय, लोगों के विचार तो रंगे होते हैं, इस देश की सारी प्रणाली ही outdated हो गयी है। मुझे समझ में नहीं आता है कि अरविंद क्‍यों जमानत ले। ये सारे कानून अंग्रेजोे के बनाए हुए है, जिसे वे भारतीयों के खिलाफ दुरुपयोग करते थे। अब उन्‍हीं कानूनों का दुरुपयोग एक तथाकथित भारतीय दूसरे भारतीय के विरुद्ध उपयोग करता है। अंग्रेजों को तो भगा दिया, परंतु उनके हथियार का उपयोग किया जा रहा है सत्‍ता पक्ष द्वारा। अगर अरविंद को जेल भेजकर किसी का भला हो रहा है तो ठीक है, भला होने दो। एक दिन अरविंद का भी समय आएगा। more
