The amnesty scheme (Abhay Yojana) for occupation certificate for individual flat is a big lie. When visited the TMC to get OC for individual flat, the response was very discouraging. This scheme had many inherent flaws that make the process impossible to get an OC for individual owner doesn't matter if the flat is exactly as per plan and all the papers are also at place.

I will tell a little about the staff at TMC later, but first principle issue.

This scheme does not help in case of lapses from Societies Managing Committees. This is the main reason why a member would want to get individual OC. If the committees are actively operating, they would also get OC. There are many documents required which are turned down by the managing committees for example structural audit of the building, which hardly any Society carries out on every year basis to save huge expenses. In place there could be a provision of inspection and audit of the flat byk TMC against some fees if managing Committee doesn't provide the same.

The staff at office in town planning department is friendly, and I am not sarcastic. They are indeed friendly, but so much so, that they advice against application for OC. They also politely tell failed track record of applications and flat owners actually getting OC for flats which is very low and discouraging. They also go to length that there is no guarantee of getting OC even if paid all the fees and submission of documents because the laws are stringent and the RTI has made life tough for government servants so, no staff/officers wants to take risk and responsibility to give OC, which might prove wrong because of so many laws.
