Vodafone bankruptcy should require consumer compensation

Vodafone Idea will go bankrupt soon as they owe 40000 crores to Govt. Vodafone should not be allowed to go bankrupt like this. Why did they take this liability If they knew they did not have the where with all to pay these dues. Or bought in hope of waiver. And the Govt must hold
Promoters accountable for dues and provide a six month guaranteed service to consumers giving them time to switch.

The joint venture between telecom companies Vodafone and Idea — Vodafone Idea is now on the verge of filing for bankruptcy and winding up the business. The news comes after the Supreme Court, on Friday (February 14), pulled up Vodafone Idea for failing to clear the dues.

As of now, Vodafone Idea owes the department of telecommunications (DoT) more than INR 40K Cr in dues related to adjusted gross revenue (AGR). The SC had given a deadline of January 23, 2020, to the company for clearing the dues. However, Vodafone Idea had not met the deadline because of which the apex court has now called out the company.

In response to the decision of SC, chairman of Aditya Birla Group Kumar Mangalam Birla had said that if the government doesn’t provide any relief to the company then it will be left with no option but to “shut shop”.

Besides Vodafone Idea, other telecom operators which were to pay these AGR dues include Bharti Airtel and Tata. Overall, these telecom companies owe over INR 1 Tn to DoT. During the hearing, Bharti Airtel escaped itself from the wrath of SC by pledging that it will pay INR 10K Cr dues by February 23, 2020

While Airtel has bought itself a sigh of relief, Vodafone Idea is yet to finalise its way to come out of this debacle. On Saturday (February 15), the board of Vodafone Idea is expected to decide whether the company should file for bankruptcy or to raise funds to pay the due amount.

A source close to the development said that if the company gets assurance from the government that paid AGR will offset by immediate tax refunds then Vodafone Idea might go for raising additional funds.

Moreover, a recent report by credit rating agency Crisil has highlighted that the company’s existing liquidity, which stands at INR 15,390 Cr will be way short of what it has to pay to the DoT. Coupling these factors with the recent weak performance of the company makes it more difficult for the company to raise new capital.

The report further added that the solvency of Vodafone Idea can now only be prevented if the government provides significant relief packages on time to the company.

Additionally, over the past few years, Vodafone Idea has been seeking a tax refund of INR 7000 Cr from the income tax department. Reportedly, while Vodafone Idea is expecting a tax return of INR 1000 Cr from the Mumbai office of the IT department, the company is also waiting for a tax return of INR 6000 Cr from the Delhi unit of the IT department. Notably, the tax return dates back to the financial year 2005.

Another way, by which Vodafone Idea can prevent itself from shutting down the operations is that if the government changes the definition of AGR, retrospectively. This will help in reducing the total liability on the company, the source added.

If Vodafone Idea heads towards bankruptcy then India’s telecom industry will be left with two major players — Bharti Airtel and Reliance Jio. Interestingly, Jio had become the largest telecom service provider by market share in India last month. more

It has become a habit of few corporate sector to delay payment of govt dues. They are personally wealthy. Why not Govt. take over personal immovable and moveable assets by exercising ordinance asap. No delay dally . more  
It is surprising that Govt. or Institution liable to collect the dues remain Silent till it accumulated to lacs of Crore, although Consumer is regularly paying the Taxes & other dues, it Happens with few Air lines also If Private player are not in a position to meet Break Even Point , why they are running the Show , is it for draining the Govt. fund or enjoying payment made by consumer for their indivisual showoff, the owner or Partner of those bank corrupts living life of King of Kingdom and putting pressure on Govt. as well as new enterpruneur fleshing msg that these kind of business are not feasible also by adopting wrong practices putting pressure on Govt. Institution. My suggestion is that System should be evolved in which at the time of payment from Consumer or Customer, Taxes etc. directly may transferred to the collecting institution e.g if customer of vodafone releasing a payment of Rs 400/ System may transfer Rs 300 to Vodofone & Rs 100 to Institution collecting Tax & others. more
