SO NEAR YET SO FAR : MAY 19TH 2018 :

Dr .Ambedkhar and others have given a constitution best suited for India to suite the diverse nature of people . They haven't left any one unsatisfied or fully satisfied. Every section was given debating points . So every thing depended on how the Counsels argued and presented.

Hon'ble Vajubhai Rudabhai Vala, the Governor of Karnataka was the real Hero yesterday . As he carried out the Orders of the Supreme Court Bench for Floor Test correcting his hasty order of 15 days.

- A lot of things could have happened in these 15 days . I don't know if there is a provision to poach a Legislator Elected by People for another party in the time given [M.L.A. - in this case] . 45 Days are given for electioneering and propaganda, why an extension after the people have passed the verdict .

Justice heading the hearing said " ULTIMATELY IT IS A NUMBERS GAME AND THE PROOF OF THE PUDDING IS IN THE EATING " - rightly said.

When objected to by the counsel for BJP for want of time " FLOOR TEST SHOULD BE TOMORROW THIS WAY NO BODY GETS TIME AND WE ARE NOT GOING BY ANY POLITICAL PARTY " - fair enough .

After the single largest party without majority was invited in Karnataka , a ripples effect was witnessed across the country by the Single largest parties who were denied the chance to form a Government .Congress leaders in Manipur and Goa , RJD in Patna approached the Respective Governors citing Karnataka example to write the past wrong . Jai Hind . more

Speech of Dr. Ambedkar in the Constituent Assembly declare and specify “ ... Our Constitution lays down what is called Parliamentary democracy. By Parliamentary democracy we mean “ one man, one vote” . We also mean that every Government shall be on the anvil, both in its daily affairs and also at the end of aa certain period when the voters and the electorate will be given an opportunity to assess the work done by the government. The reason why we have established in the Constitution a political democracy is because we do not want to install by any means whatsoever a perpetual dictatorship of any particular body of people. “ This why, the Preamble of our Constitution guaranteed placing the issue of “ JUSTICE, social, economic and political “ atop of the 4 [four] mandates. Therefore, Allowing a refused, rejected and defeated Party to share the Rule in the Country in any form and pretext, IS ABSOLUTELY AGAINST THE CONSTITUTIONAL GUARANTEES TO ITS PEOPLE . There shall either be the Re Elections or, President’s Rule if no Member of the House of any party do not extend support the Single Elected / Coalition Party. If the Coalition party acquire majority where the Ruling Party is part of that Coalition, the issue of Refusal to such Political Party will not arise . Therefore, the awarding opportunity of Ruling in Karnataka State to the non aliened Congress and JDS stand against to the concept and objectives of POLITICAL DEMOCRACY THAT CONCLUDED WHILE IN ADOPTANCE IN INDIAN CONSTITUTION. more
Now I have 2 questions on this : 1. The same rule of the single largest party to be called for forming Government in the 3 states mentioned above should have been exercised , isn't it ?. 2. Why 15 days time to show majority . 3. How will the majority be shown with only 103 M.L.A's where as the requirement is 113 ? I haven't been able to get answers to the above . As I have seen many of your posts , your knowledge on legal matters are evident . more
The legitimate issue is that the refused, rejected and dethroned Ruling Party shall not be given share to Rule. Otherwise, the concept of Dr. Ambedkar adopted in the Constituent Assembly stands challenged and really it is Constitutionally against the Objective and concept of Parliamentary political democracy . Lok Sabha and Assemblies are the HOUSES OF PEOPLE AND, the party refused by People's Vote shall not be continue in power even through parting a share. more
Their crowning for the Rule though fall within the Laws existing, ABSOLUTELY AND GROSSLY AGAINST THE ETHICAL MANDATES OF ELECTION UNDER THE INDIAN CONSTITUTION under the issue of Justified Election, moral Justice SINCE THESE CONGRESS AND JDS DID NOT RECOGNIZED AS THE COALITION PARTY . Dr. Ambedkar's comments in the Constituent Assembly on the issue of legitimate right of Voter Citizen to refuse the ruling party to have a better justified rule to them through the Political Contestant Parties IS NOW SET FOR EVER CHALLENGING THE JUSTIFIED RULE AND LEGITIMATE POLITICAL DEMOCRACY. This undemocratic, unjustified, immoral issue is in deed against to even Natural Justice and to be SET FOR NECESSARY REFORM AND CORRECTION OF THE PART XV . Loop-hole set, stipulation left out in the Elections part XV of Indian Constitution, neglect even in Amendments adopted from 1956 to 88 ignoring the basic and fundamental issue of Peoples's Verdict on Ruling Political Party IS THE ROOT CAUSE. The Parties that brought amendments to ELECTIONEERING IN THE COUNTRY during the preliminary 38 lengthy years grossly neglected this PRIME ISSUE of People's Verdict and Refusal that aught to have been provided to fulfill the BASIC DUTY OF ELECTION disqualifying such refused Political Party to opt continuance of Share in Rule in the Country. This Lapse is the nothing but to encourage the oppressive and suppressive Ruling Political Parties forever in the Country preferring alliance with the PARTY THAT HAD REFUSED AND DEFEATED THE RULING PARTY . This is nothing but deceiving people and Citizen who are the BASIC DICTATORS OF THE REFUSAL AND REJECTION OF THAT PARTY to be in continued rule . Thus, the after Election coalition of Congress and JDS allowing majority share in the Rule of Karnataka State for the Congress that was rejected, refused and dethroned by the VOTER CITIZEN is absolutely against the Constitutional Concept of ELECTION IN INDIA. more
