PF issue

I need to know that my provident fund is stuck in my previous company and provident fund number was also not mentioned on salary slips but I want to apply for this. Please let me know how is it possible?

Hi Aman, it depends on actual absconding or company marking person as absconding for not servicing complete notice period. In case of notice periods like 2 or 3 months, it may not be feasible to server entire notice period as new company may pressurize you to join ASAP to avoid losing you to another competitor where you cud get better offer. On the other hand, companies who have nothing to offer to stop you may bring legal angle on your notice period clause. In such cases, companies generally clear your accounts. If you are really absconding and company is after you for something genuine, they may keep it on hold to catch you. However, to your answer, NO they can not hold anyone's account. But as they are sole authority to clear the same, they may and do use it as a tool to traumatize you. What you can do is to reach them personally and get that sorted, they will keep you waited and waste your time, but if you are persistent they may clear the same. I am sure you may appeal in case they do not clear and you have substantial proof that you have done enough follow up, but sure of the place or authority which can give you justice here. You can consult a lawyer and he may help you t move to next legal level if things don't move in spite of your best efforts. Always remember, there is no effort unless you document it. Send mails with reminders every week. If possible grab proofs of your personal visits as well. All the best for your fight ! more

In case even by visiting the PF office the matter is not resolved then another option is to file RTI application to the concerned official in the PF department. Application under RTI can be filed online. more
