LEASE AGREEMENT
This Lease Deed made on this day of 15th APRIL 2014 Between Sh. ASHOK KUMAR S/o Sh._____________ R/o ___________________, GURGAON., (hereinafter Called “Lessor” , which expression shall include their heirs, successors, Legal Representatives and assigns) on the one part
AND
second Part ___________________________. (hereinafter called “Lessee” which expression shall include its Legal heirs, Successors, Legal Representative and assigns) of the other part.
WITNESSES AS FOLLOW:-
1. Where the Lessor has undisputed Legal ownership and possession of the Residential premises House No.________________________________
2. Whereas the Lessee is desirous of taking the premises consisting of House No.________, to as “The Leased Premises” on the term and conditions contained herein for the exclusive Residential use of and his / family / staff / company only.
NOW THIS DEED OF RENT WITNESS AS FOLLOWS:-
That in pursuance of the foregoing and in consideration of the rent hereby reserved and the covenants of the Lessee, the Lessor hereby grants a lease and the lessee hereby accepts a lease of the leased premises on the following terms and conditions:
DURATION OF LEASE:-
The period of lease shall be for 11 Months commencing from _________to_________. At the end of this 11 Months period, this contract is renewed on the basis of mutual consent on such next term lessee will vacate the premises with in time period of lease term, if lessee take time to vacate the premises then lessee pay 1000/- (One thousand Rupees) per day.
2. RENT:-

2.1 The Lessee shall pay to the Lessor for the occupation and use of the premises a monthly rent of Rs.____________________) by Cheque /ECS payable in advance by the 7th day of the receipt thereafter. The rent shall be enhanced every year by 10% as mutually agreed by the LESSOR and the LESSEE.
2.2
That the Lessor shall also maintain an interest free Security Deposit of two months i.e. ___________, which shall be refunded to the Lessee at the time of vacation.

2.3 That the Lessor shall also maintain an advance rent.

3. ELECTRICITY AND WATER CHARGES:-

3.1 The Lessee shall bear and pay the charges of electricity actually consumed by it in the leased premises to the concerned authorities / suppliers as per bills received by him or reimburse the same to the lessor. The maintenance charges payable to Owner will be borne by the lessee . The Lessee will abide by all the rules and regulations of the authorities and will be held responsible for and contravention of such rules.


4. USES OF PREMISES:-

4.1 The lessee shall use the leased premises strictly for the residential purpose of_____________________., and his family/staff.

4.2 That the lessee shall permit the Lessor or their agents to enter upon the premises for inspection and for carrying out repairs, etc. if any, as and when necessary.
4.3 The lessee shall not use the said premises for any illegal, objectionable trade or business or sublet, underlet, assign or otherwise part with the portion of the premises or any part thereof or run any illegal activities therein during the continuance of tenancy.

4.3.1 During the term hereby created, the Lease shall be entitled to put up as his own cost internal partitions, install air conditioners, air coolers, refrigerators, cooking ranges and other electrical domestic appliances and telephone connections. However, if the Lessee wants to make permanent partitions of other alterations, the Lessee shall obtain prior written consent of the Lessor.

5. MAINTENANCE:-


5.1 The lessee shall keep the leased premises in good tenantable condition and order and shall not cause or suffer any damage thereto, fair wear and tear always expected.

5.2 The Lessor shall carry out the internal repairs and works of maintenance, painting and colour washing to the lease premises at his own cost, the whole premises prior to the commencement date.


5.3 The Lessor shall be responsible for all major structural, electrical and plumbing repairs but minor repairs and day to day routine maintenance, such as leakage of taps, replacement of fuses etc. , shall be done by the lessee at his own cost and expenses.

5.4 That the Lessee shall comply with all the rules and regulations of the local authorities whatsoever in relation to the demised premises in so far as they relates to the use of the premises for the residential purposes.


5.5 That the Lessee shall pay for the electricity, water and all other common (like electricity charges for the common space & maintenance charges).


6. DELIVERY BACK OF POSSESSION:-



6.1 Subject to the provisions of the deed, the lessee shall deliver vacant possession of the Leased premises to the Lessor on the expiry of the lease period thereof in the same condition in which it is let out, on termination of the lease subject only to changes previously authorized by the Lessor or caused by fair wear and tear.

6.2 The Lessee at the time of occupation shall see that all the sanitary, electrical and other fittings and fixtures are in perfect working order, nothing is broken or missing. The lessee shall be responsible to restore them in the same condition, natural wear and tear and damage by the acts of God excluded.

7. TERMINATION:-

7.1 In the event of the Lessee failing to pay the rent hereby reserved for a period of 2 (Two) months consecutively or committing breach of any of the terms of this deed and if within thirty days after written notice the lessee has failed to remedy such breach, the Lessor shall be entitled to terminate the lease and re-enter upon the leased premises.

7.2 The Lease may be terminated by giving one-month notice either lessee.

7.3 Any Dispute rise between both the parties the court jurisdiction will be Gurgaon.



7.4 THE LESSEE COVENANTS WITH THE LESSORS AS FOLLOWS:-
That it will pay the rents regularly and duly carry out its obligations as lessee as per these presents and under any law.
That upon receipt of any notice or order from any authority relating to the leased premises or the lessors, the Lessee shall cause the same to be delivered to the Lessors.

THE LESSORS COVENANTS:-

The Lessor is lawful holder of the leased premises and has the right, title and power to grant the lease in respect of the leased premises free of encumbrances, restrictions whatsoever from any third party which have not been disclosed in writing to the Lessee prior to the execution of the deed of rent.
The Lessee on duly paying the rents and observing the terms of this lease, shall be entitled to the peaceful and quiet enjoyment of the leased premises during the terms of this lease thereof without any interruptions by the lessors, its urgent, servants any persons lawfully claiming under or in trust for it.
In witness of, the parties have executed this deed of rent in the presence of the witnesses attesting hereunder.
