Forced extraction by RWA/Facilities for paint cost

We stay in Vatika City, Sec-49, Sohna Road, Gurgaon. RWA here wishes to go ahead with Facade Painting project in society at a high-priced tender rate. They are thrusting this unnecessary cost on the residents at their dictated terms and have also mentioned via circular that this cost will be deducted from resident's monthly prepaid metering system (recharge coupons used by residents for electricity, water needs), if not paid by a certain date (07-May). This is sheer harassment, and even criminal. What can be done to stop this? URGENT inputs please. more

Same thing is happening in Sushant Estate as well. Most of the residents feel harassed but some have taken the legal route against it. Ideally electricity is an essential service and charges paid for electricity should not be used for anything else. You should definitely take a stand against harassment. more  
The issue relates to whether the RWA is empowered to take this call or not. Is it part of maintenance, or beyond the scope. Is facade integral part of an individual house or a part of common areas? Can a heavy expenditure of such nature be forced on every individual without his wish? For all these one has to study the main objectives and detailed objectives of the Bye Laws of the Society as registered in the first place. Whether a General body can approve such an expenditure and if so what is the quorum required is a legal determination of the issue. If the re-painting is taken to constitute a part of re-construction, then even if a single resident objects to it, it can not be done. If not, the provisioning and quorum can approve it. A practical solution shall be to obtain quotation from companies with good brand image , ensuring that all the standard terms and conditions as contained in the quotes procured by RWA, to ensure good quality of work which can take care of buildings' protection for a reasonably long period' are addressed. Since RWA and the residents shall also like the work to be accomplished within reasonable time period to take care of timely maintenance, the exercise, if desired to be undertaken, shall have to be completed expeditiously . more  
Would it fine/ helpful to ask RWA of these questions upfront? 1. Show the list of tenders received from all vendors for painting, and explain the reason for picking this particular vendor (with higher rates) 2. Minutes of Meeting of the General Body Meeting where the decision around tender approval and the reason for picking that was taken Anything else? more
