Are all socieites of Ghaziabad under RWA or AOA bye-laws? What is the difference. more

Dear Atul Ji I agree with with your comments by and large , but coming to elementary question `Are RWA and AOA different`, I beg to disagree as both are significantly different in structure, functions and administrative working. Fact that UP Apartment Act 2010 was enacted to replace Societies Act, 1861 for converting RWAs into AOAs...this itself stands testimony to differential aspects of AOA vis-a-vis RWA. That short-comings of RWA were addressed and removed in guidelines for formation of AOA is another pointer that AOA differs from RWA. However, practically speaking the administering and registering agencies in the state have done precious little in implementing the UPAA-2010 in last 5 years and hence benefits of AOA under UPAA act still evade RWAs who have converted to AOA. There is no difference. The UP Apartment Act 2010 and/ or Model bye laws, do not specify any name. It can be even other than AOA or RWA like Society of Residents etc. It is only headedness of offices of GDA and Dy Registrar Societies because they don't want to apply their mind. It is very much legal and not at all illegal under UP Apartment Act 2010 to have any name. Those who think that AOA means Apartment Owners Association and that UP Apartment Act 2010 is meant foe Apartment owners only, they are highly mistaken as Allahabad High Court has clearly ruled that tenants, relatives can also have voting right and are members of the RWA/AOA/ any name you give. more  
In fact the GDA in connivance with Fed of AOA spoil the concept of AOA for the benefit of builders. more  
Mr. Chandradev do you think there is no difference in between RWA & AOA if so pls spell the full form of RWA & AOA and you will notice the difference. more  
RWA differs from AOA. One needs to read thru AOA guidelines under UP Apartment Act, 2010, to understand differences between RWA and AOA in depth. All existing RWAs need to get re-registered as AOA (Apartment Owners` Association). Nov 2011 onwards all RWAs need to follow AOA guidelines whether or not registered, as per hon`ble Allahabad High court`s landmark judgement in 2010/2011. Thus all societies in U.P state need to abide by UP-AOA guidelines which give rightful near absolute powers to Apartment owner as collective owner of society land and common property harboring his/her dwelling unit. AOAs now come under aegis of GDA for administrative functioning and under aegis of Registrar Societies Meerut for statutory and registration needs. regards Pratyush more
